Off to court
About a week before chirstmas i got a summons to go to court.
It had to do with may accident on June 28, 2002 when i had
my first civic.....it was a 2002. The lady is suing me saying that the
accident was my fault. Here's what happened:
I was heading north on a street (going the speed limit which is 70 Km/h)
coming up to an intersection where the light was green. She was heading
south on the same street and decided to make a left turn to go east
right in front of me....and of course i didn't have enough time to slow down
so i ended up running into her on the passager door. Both cars where totalled
off. (pictures are below one of my car and the other car, sorry not very clear).
The court date is not till Feb 12 and is a waste of my time.

Sorry to hear that dude. Good luck in court. Just be cool and talk when spoken to. By the way it looks, its her fault. Unless she had a green arrow to turn, but you said the light was green. Sounds like she is trying to get some money out of you and your insurance. What did the police report say?

She was originally charged with driving with undue care and attention and she went to court to fight it.....the only reason she won was because the cops don't want to waste their times with things like that so she got off and plus i wasn't their to tell my side of the story.....so i guess since she got of of that she thinks it wasn't her fault.......from what i've heard she's not to bright.....i feel sorry for her son who was 7 and sitting in the passenger seat.....broke his collar bone or something.....

i can't see the pic, but from what you've described, sounds like she may get a settlement. this is just an assumption though. i have a few questions before actually determining this though. 1. at this particular intersection, do you have to recieve a turning light to make said turn? (meaning is it posted saying left on arrow only). 2. did she use her turn signal?
however, after further scrutiny of your post, she may get nothing. i failed to notice where it said you hit her in her driver's door. if you hit her that far up on the car, she turned with a lack of room to make said turn. if the impact had been further back, she may have had a case (meaning if it were further towards the rear of the car). who knows? the only way to be certain is to go to court. if i were you, i'd counter sue her for pain and suffering(you lost you car, which is very important to you, and you also had to wait till the insurance adjuster totaled the car before having yours replaced), and lost wages due to going to court. that might also make her decide to drop the suit, being as you are countersuing, and she sees/knows she was cited in the police report, and may end up having to pay. also, shouldn't this be in the legal forum?

at that intersection your can turn left on a green light.....but only if its safe to.....meaning the vehicles going straight have the right of way.....and i can't really remember if she had her turn signal on.....it all happened in a matter of seconds.....
If for some reason i do lose this.....its almost like saying that you can't drive through a green light.....i know you do have to pay attention to other ppl because you can't always trust the other people around you.

sounds to me like an open and shut case, you had a soild green light and she had a green arrow. its up to her to watch for oncoming traffic, simple as that.

Just be cool. You'll win, as long as you dont speak out of turn, listen, and think about what to say before saying it. If you both had solid green lights, she has to yeild to on coming traffic before turning to a street. But if she had a green arrow, your light should have turned red. Thats how LA lights work. I'm sure their universal. I agree with the counter sue. Just be light and not rash. The worst they can say is no. Try doing a little research before the court date. Have a copy of the police report, pics of the intersection, pics of both cars, etc. Get everything you can to defeat her arguement.
