Driver Door only locks sometimes

So originally the door wouldnt lock with key or button (i dont have remote). the little red tag moves up and down slightly, but never actually locks. i can always open the door. every once in a while, if i use the button, it will actually lock. however when i exit the car and press button again, it doesent lock....
sorry for the repetitiveness.

Is this the actuator? or maby something is just loose? btw the whole door panel is not attached very well on the bottom (looks like some botched DIY work)

Even odder, my key does not lock/unlock the passenger door. it seems it doesent even fit. it works for the trunk, but not to unlock the seats, or the trunk lock by the gas/trunk popper. does this have something to do with it?

They key is NOT a factory key, there is no honda emblem or engraving on it.
