Proparts rant....I've finally had enough...warning VERY long
I dont really know if the whole legal/lawyer thing will work for you Will. There is a general presumption in this sort of situation: caveat emptor - let the buyer beware. And yes there are measures to protect consumers from unreasonable situations caused by vendors but I am not sure your situation would be covered.
I agree that this situation really sucks and hardly seems fair, but from a devil's advocate role I would say that even though they told you not to worry about yours coils as the wiggle got worse and the warrarty period expired it was you who must have taken action to get them in to Proparts before the period expired and to obtaine evidence that it was done.
Also, since the warranty is a manufaturers warranty, it would seem like it is Hayame who must refund the money and not the shop. Although it would be good business practice to refund the customer the money on the spot and then have the shop deal with the manufacturer, it is not the law as far as I am aware.
Anyway, I truly feel like this is a raw deal for you, but just wanted to bring up some points form the other side. I am in no way trying to support Proparts (Ive never had any dealings with them)

Very good points jer, something I was aware of but good knowledge and definitely good to have the other side of things on this thread, it was starting to get a little one-sided. Let this be a lesson to all of you, KNOW your warranty, keep all documentation (and find out where the shop owner lives, lol).
Sure, caveat emptor, but let's not forget as well, caveat venditor, let the vendor beware. Cause even if I should have been aware that I was going to be screwed, that does not completely exonerate the vendor from MY dealings. I'm still optimistic that this will be resolved cleanly, but I will let you all know in a week.

Well, the situation is now closed. I won't say resolved since I got back less than half the value of the Hayames, but due to the nature of the original transaction plus transgressions on both Mike P's part and my own, this could have stretched out a lot longer than expected and frankly I'm tired of fighting this fight. It's not fair, and I still feel a little bit (A LOT) fuqt over, but I have better things to stress out about, and I have been losing sleep and patience with people over this matter, and better for me to lose a few (a LOT OF) bucks and at least have this weight off my shoulders.
That said, I do have to give Kent props. After my not-so-gentle pushing he went to bat for me, and he did what he could. I hope he continues on with a stong focus on customer satisfaction, and maybe, just maybe, Proparts will have a better reputation following this incident. I know I don't plan on going back there myself, but I did promise him I would post that he did the right thing, which he did to the best of his ability.
Thank you to ALL of you for your support and kind words, it really did my heart good to know that people were willing to speak up on my behalf, and that I wasn't crazy for asking what I felt I deserved. Maybe there is hope for the tuner scene in Toronto after all.

Its good thats it's resolved even if not to your 100% satisfaction. Now at least you can move on an try not to think about it too much.
But this was a good post for people to learn about warranties and verbal promises from vendors, unfortunately at your expence Will.
