Got a freakin ticket!

I was rounding a curve going pretty fast going uphill and then there was this cop car in front of me sitting in the middle of the road in the turn lane , then I slammed on my brakes but it was too late, he started following me and flashed his lights soon after. I kept driving a little bit to find a safe place to stop and the cop came up to me and asked why the **** didnt i stop when he flashed his lights and i said i wanted to find a safe place to stop and he was like stfu you have to stop immediately when he flashes his lights and i was like ok. Then he wrote me a speeding ticket of radar-clocked 57 mph in a 40 mph zone. So this is 17 mph above the limit, is this a very serious speeding? So how does this work? Is it that i can show up in court and contest the ticket and if i lose i cant go to traffic school? How can i fight it? Cuz this is my 1st speeding ticket. Thanks for reading.

Reckless driving? Dang that was in my mind too! Does anybody know what it is in CA? It didnt say anything about reckless driving on my ticket though.

I was thinking up **** to talk about the radar. Like there were cars going in either direction on either side of him, and there were cars behind and in front of me that can cause interference. Can i still ask for radar calibration info or my speed record on it when i go to court?

Also this cop was using angry tones when he first approached me when he bitched about me not stopping immediately. Can i use anything against him in here?

also, just take defensive driving, then it wont go on your record once you complete it. This goes for you and everyone, when you get a ticket, it isnt the end of the world. You have several options, and if you are smart, you will know how to keep it off your record.

if its your first ticket, get defferred adjudication in which u pay the ticket and doesn't go to your record. but don't get any for a certain time after that.

or

driving school.

i got mine at 20mph over and defferred only cost me about $155

when i was 16 i got a ticket for going 63 in a 35 (28 over) and when i went to court i didnt even contest it. i just accepted thefact that i was speeding and the judge was cool about it. had a $47 fine and a $70 court cost for a total of $117 and my insurance never went up, even now a year and a half later.

The thing about pulling over right away is total bs. If you signal to the officer, you are allowed to pull over somewhere safe. The only thing is you have to signal, and he has to understand you. Don't worry about being in trouble for that, it's not a big deal at all.

Check the back of your ticket, it usually tells you what violation equals what, and some states even put "20+ mph over speed limit = must appear in court." If you have a clean record and it won't be a reckless driving, you can either just pay the ticket and plead no contest, or go to court, plead guilty and see if they will drop the fine down, or make you go to traffic school.

talk to the prosecuter and plea it down to "driving in an unsafe manner." this will be a fine but a no point violation. and like everyone else said, you are allowed to wait for a safe place to pull over.

You can bring it up, but it will not do anything. Most states 15mph is a threshold number. In most midwest states they take off 3 points - reckless driving around here is much more serious you have to be doing something really f'in stupid to get that. 3 points is the minimum to show up on the insurance reports.

Honda Sales gave the best advice - talk to the prosecutor. If your barely over 15mph like you were most cops will write you a ticket for just under the threshold. Sounds like the cop was a ***** - how long did you wait to pull over? When I was a cop I appreciated people that found a safe place to pull over, so long as it wasn't more than a block or two, and it they turned there blinker on to signal to me what they were doing.

Yeah, you can pick a safe place.. but you have to signal.

It's a really fine line, some officers say at 3 blocks, you're evading arrest and there's trouble. It really depends on the local law and the officer.

From where I had been in the Southern States, like AL, AK, LA, MS etc...if you go just about 20 mph over the speed limit, its considered manslaughter. And of course, the cop has the right to arrest u. Its that stupid.
