Dog Damage??!?!?!
heres the story: i was drving on a rainy night and i hit something and i didnt even see it. i pulled over and noticed radiator fluid pooring outta my car. went home and got the other car. i hit a black lab. i know the man who owned the dog and he didnt even care about the damage to my car. in toledo you have to have a leash on your dog in city limits. so the warden ticketed him. i called the insurance company and went to the police and all that. the estimate: 1,239.62....from a dog. now i know if i would have hit it with my Audi 200 turbo there would not have been a dent. the front bumper, ac condeser, and radiator were broken. and heres the worst part
i had to pay 500 dollars because somebody cant keep there dog in there yard. never the less i went to small claims.
is there anyways to strenghten our front ends? and god these cars dent easy, prolly trying to make them super light.

my parents have a black lab. for those that don't know, these are relatively large, 70-lb+ dogs. they're hunting dogs and like to roam their territory. some people have lots and lots of sex which often results in having children. growing up, kids (inherently stupid until age 25) like to roam their territory as well. both dog-owners and parents care greatly for their "children" (whichever species that might be). but, you can't always have control over something that has its own mind, will, and at least two legs to run with.
the point is, that this just as easily could have been a kid running in to the street (that dog probably was the owners' "kid" -- they love their pets). if it HAD been a human child, you'd be in jail right now.
YOU made the mistake of not paying attention. BAD WEATHER = PAY D*MN CLOSE ATTENTION TO YOUR SURROUNDINGS, PEOPLE! what makes you think you have any right to file with small claims? that just puts you right up there with the "i'm-suing-mcdonalds-cuz-i-spilled-my-hot-coffee" morons of this world. sure, i'd have sympathy... but how blind were you to completely miss seeing it, even right before you hit it? "hmmm... *BUMP*... gee, marks on the bumper... leaks under the car... I WONDER IF I HIT SOMETHING?!" hmmm... i wonder if you deserve a license?!

hey I hit my own dog, paying VERY close attention on a sunny day, he got out and ran out in front of me. If you hit a child who darts out from a car if you are not negligent you dont get in trouble.

That's considered a PD (property damage) accident. The law regards dogs, or any other domestic animals for that matter as property. New York State requires that in the event a domestic animal is struck, the owner of the animal and/or the police need to be notified. I would be rather frustrated too, if I was you. Clearly no one hits a dog on purpose to cause injury to the dog or damage to their vehicle. The fact that the dog's owner was summonsed by a government official shows that he was in the wrong. While you might not get all of the money you ask for, I think you might have a chance to regain some of your loss in small claims.
bhayes82: what's your problem dude? you need to chill out. it was obviously the owners fault for not keeping his dog on a leash or in a fenced in area. who's to say he wasn't paying attention? were you in the car with him? I think you need to chill out before you post dude.
If you hit a human being (and you stay on scene) you'll be questioned and unless the police can prove right there you or your vehicle was impaired/unlicensed/unregistered you will usually be let go, pending an investigation. Then based on the results of the investigation, you will be charged with vehicular manslaughter, or the investigation will be dismissed. If your speeding 55 in a 25 and smack a kid, you're done for. If you're going 30 in a 25 on a sunny day and out of nowhere some kid jumps out, and you're sober, licensed, and registered and all your ducks are in a row nothing will happen to you.
edit: note... If you're cleared of all criminal charges you can still be sued in civil court.

Noodleboy...in New York State, the pedestrian has the ultimate right-of-way NO MATTER WHAT. You MUST yield to a pedestrian. Even if they cross against the light, even if they jaywalk, even if they cross in between parked cars, even if they are intoxicated...etc. etc. New York is one of the few, and possibly the only state that will hold both the registered owner and the operator of the vehicle responsible for pedestrian accidents. This does not apply for dogs as they are considered *personal property* by law.

So let's say in newyork, u're doing 30 in a 30 zone, sunny day, sober, licenced and registered owner of the car. Then out of nowhere some kid jumps out from nowhere and u hit him and he dies. Are you going to be arrested? Apart from being sued in a civil court are they any other dangers? And how would you loose in a civil suit if there was absolutely nothing you could've done cuz even if you're doing 30 and some lil kid just jumps in front you'll still not be able to stop in time and he will be hit.

My godbrother hit a damn BUCK in a fr@ggin saturn at 55mph! The car was totalled, the buck came halfway thru the windshield and lost his antlers (my Godbrother still has them), and how about that big fr@gger got up and BOUNCED!!! The only proof he had when the cops pulled up was the antlers and a little blood. They still fr@ggin checked him for alcohol! Noodleboy, the operator would be in the wrong automatically simply due to the fashion in which the New York State VTL (Vehicle and Traffic Law) is worded. There would probably be no charges according to the scenario you presented. However, your insurance would be gone and you would probably be sued in a flash in state court.
first of all your an idiot...you had to have been going pretty quick to cause that much of damage to your car from a 70lb dog.

remember folks are cars are nice and safe. we have crumple zones that just give up in a crash. My father had a tire blow out and he slowed down but right before stopping he lost control and hit a pole at about 10 mph, no airbag but the front end looked like a headon....
I had a dog jump up on the side of my car and scratch it I got so **** off. Cat got on my hood at night and slipped and clawed it I can't keep it looking great like that.[IMG]i/expressions/face-icon-small-mad.gif[/IMG]
bhayes82, your analogy with children makes no sense. children don't roam their territory on rainy days. as required by law, and common sense, that dog should have been on a leash.

I thought we learned that in elementary school. regardless of whether the dog was the owner's pet/friend, it was the owner's responsibility as well. sure i'd feel bad if i was the driver, but the blame lies on the owner. hence, the ticket to the owner only.
