Alright guys I have a quick question, my friend has a 97 ex, w/ a d16 in it. He recently had to rebuild his motor so while they were in there , he had them bore it 40 over. So my question is what liter is his engine now?

really, it would still be a 1.6 liter.
the stock bore stroke is 75x90. with a 40 overbore, i'm assuming that's a .40 difference. and 75.40x90 is only about a 20cc difference. so 1590 stock vs 1608 with his overbore.
so, 1.6liter

Generally, when you say "40 over" you mean .040." Assuming that is what he means, an increased bore from 75mm to 76mm will increase the displacement slightly.
.040"=1.016mm

it still wont help too much...... and the old D series..... well, it's a D series, still wont respond as well to a B series.... but they did have variable valve timing on the intake side.....

It's a little less than 3% increase in total displacment. Presuming a linear relationship between displacment and hp (a safe assumption on this scale), it should be good for about a 3% increase in hp.

I don't know what kind of an increase it is. Usually you overbore an engine when you rebuild it to give yourself clean cylinder walls to work the new rings into. As far as making more power... look up the NASA Honda Challenge rules for the H4 class. Whatever that allows you to do to a D16 is good for about 140 HP. I know you can overbore it, but I don't know what other motor work can be done. I would speculate its pretty mild, given the rules are usually intended to keep it pretty uniform and semi-affordable.
