stupid cops

so yesterday i was driving going like 48 in a 50 in 5th gear with a cop behind me to the left. never started to speed and never took off and he starts running my plates and then jumps behind me and pulls me over a few minutes later. he comes up and says that my exhaust is to loud when i was in 5th gear and barely tapping the gas. he said you dont see anybody else doing that to there exhausts. everyone does. the cop was being a real *** and gave me a ticket for 60 and to take it off cause its illegal to modify stock exhausts. i have a megan racing axel back with stock mid with no resinator. anybody got some helpfull info on this situation. i live in md by the way.

a) 48 in fifth gear? You have a blatant misconception on how transmissions work, either that or you were driving down a 70 degree slope.

b) You modify your car without checking the legalities and then try to argue them after the fact?

c) Everyone does not do it. I have a pretty heavily modified car with a stock exhaust simply because I do my research on what's legal and what's not and I accept it.

In a way that doesn't make any sense.

Lets say you were driving a Dodge Viper SRT-10. That car has a Loud V10 engine and lets say you were going 40 mph and the cop stops you because of the exhaust being "too loud".

Basically, I think that cop just Wanted to stop you but he needed a reason Why he did in the first place.

That's how it starts: He stops you for a loud exhaust.
Then let's say you were driving without carrying your license.

So there you go. Two tickets.

1. loud exhaust.
2. driving without a valid license.

He was just picking on you at the time. Then they should Stop all the cars with Loud exhaust/mufflers: 350Z, Mustangs, Muscle cars, Etc.. What's the purpose of Aftermarket parts if they're "illegal"

just my opinion.

The loud exhaust IS LEGAL if and only if it came from the factory that way.
So a Roush mustang is all good. A factory mustang with an after marker Roush muffler is not.

In some states it is even illegal to advertise aftermarket parts without a disclaimer!
If you read aftermarket magazine ads carefully, you will see disclaimers like: "Legal only for off-highway use (except in California or states that have adopted California emissions standards)" or "Not legal for sale or use in CA, OR, NJ and MA."
On the other hand, the ad may state: "50-state legal," "California Air Resources Board (CARB) exemption," an "EO" number, or another statement that indicates its legality.
I know my BORLA muffler said it, so did the HP header.


However, aftermarket parts are legal to use only if they meet certain requirements. In fact, if they do not meet these requirements it is classified as "Emission-Control Tampering." Since the Clean Air Act of 1991, there is a $2500 fine to the owner of the vehicle, and others for tampering with emission sensitive parts. Some examples of emission sensitive parts are ignition systems, engine computers, chips, cams, throttle bodies, air filters, and certain exhaust components.

Be cautious when there is no disclaimer. The part may not be legal to use in your state!
The Specialty Equipment Market Association has instituted an emissions-sensitive product identification program. To aid consumers in identifying aftermarket parts SEMA-member manufacturers may use the following numeric/color square diamonds on their parts to indicate its proper use:
The number 1 in a green diamond indicates that the product is legal in all 50 states and has been granted a California Air Resources Board exemption, an "EO" number, or is a direct or consolidated replacement part.
The number 2 in a blue diamond indicates that the product is legal only in states that have not adopted California standards for emissions. This is the tricky one. As an example: Did you know that Massachusetts has now joined the list of states that have adopted California standards?
The number 3 in an orange diamond indicates that the product is legal only for competition, racing, marine use, or off-highway use (except in California or states that have adopted California emissions or standards) where it is still illegal.

Now about the new vehicle warranty.
Rarely does the use of aftermarket parts violate a new-vehicle warranty. The only case where a vehicle manufacturer can void the warranty is if the aftermarket part is proven to be responsible for the warranty claim. Further, it is also illegal on the part of the dealer to state that the use of an aftermarket part will void the warranty.

There are also emissions warranties. Federal law (the Clean Air Act) requires two emissions warranties:
A Performance warranty
A Defect warranty
The "Performance" warranties require the vehicle manufacturer to make repairs, at no cost to the owner, should the vehicle fail to meet certain levels of emission performance during the warranty period.
The "Defect" warranties requires the vehicle manufacturer to produce a vehicle which, at time of sale, is free of defects that prevent it from meeting required emissions levels for its useful life.
You are actually protected under a parts certification program administered by the Environmental Protection Agency (EPA).
If the aftermarket parts manufacturer certifies its parts under this program, the vehicle manufacturer cannot void the emissions warranty even if the certified parts fail and/or is directly responsible for an emissions warranty claim. In this situation, the vehicle manufacturer must arrange a settlement with the aftermarket parts manufacturer, but the new-vehicle warranty is not voided under the law.
The law is clear: Simply because aftermarket equipment has been installed on a vehicle, the vehicle manufacturer cannot automatically void the warranty.
What can you do to protect yourself?
First, know your rights as a consumer.
Second, buy only aftermarket parts that are legal for use in your state.
Remember, only parts that are a direct replacement, those with a CARB number or those labeled with the number 1 in a green diamond are legal in all 50 states.
Now a few words of caution:
Your "warranty does not cover damage or malfunctions which are the result of...use of the vehicle in competitive events."
This could include timed runs at quattro club events! Quattro club Safety Seminars themselves without speed and timing equipment are not competition events and should not affect either your warranty or insurance, but let someone drag out a stopwatch and the picture changes.

So wait, if you modify a stock exhaust by hacking the pipe and changing the muffler.... what if you yank the entire exhaust system out and swap it out- the orig stock exhaust is still in factory condition, but blah... you'd probably loose with that argument too. *snap*

man wtf. god i hate cops. he was just picking on me but i dunno what other exhaust to put on it. i dont want a full stock exhaust. i just got mine done and i love the sound. what should i do

i dont even know where to get a silencer that would fit the exhaust and they usually come with it but i dont have one. and the silencer defeats the purpose of the noise and looks ugly

I also live in maryland.

I have 2.5" pipe back from the cat and no muffler and no resinator. And I have not had any Problems. And I've been pulled over multiple times.

What you need to do is take your ticket down to your local police station and ask to see the code that the cop gave you a ticket for.

It's probably a state law, so you might want to head off to a state troopers barracks. I've heard that libraries also have them.

The books are called Ordinace manuals or something similiar. I only had to do it once.

Also Dex, WTF? I do 48mph in 5th gear all the time. What do you keep your rpm's at 5k or something?

I have an HX which is geared a little different, but there is nothing wrong with driving at 2.5k to 3k rpms.

From a breif scan of that, it looks like the cop was full of doo doo.

Like I said, you have to look on the ticket and find the exact law that they say you violated.

Just get an exhaust tip like me. It's a neat little accent without all the noise. Plus when everyone asks me thinking they're funny....

"Oh you suped up your car? Does it have an exhaust can on the back? WAAAAAAAAAAA. *laff*"

Then I can be like.. "NO." And then they stop laughing. It's great.

There should be some kinda of number associated with the ticket.
This number is the ordinance number that you violated. Mostly they have a really weird dollar sign looking thing in front of them.

You have to find out the exact law that you broke.

Sounds weird to me, and exhaust is not a 'device'. to me a device implies something that is not permanently part of the car.

okay i looked it up in the dictionary a 'device' implys mechanical or electric parts, an exhaust has neither.

first thing first, find that number

The only definition of "device" that matters is how Marylend defines it in the Transportation Article (see below).

Like 4Jacks stated you need to provide the article and section you were cited under, but my guess is the Trooper/Police Officer cited you under the following section of Maryland Transportation Articles http://http://www.dsd.state.md.us/co...sportIndex.htm

Article - Transportation
§22–402.

(a) Every motor vehicle with an internal combustion engine shall be equipped with an exhaust muffler system in good working order and in constant operation to prevent excessive or unusual noise, and no person may use a muffler cutout, bypass, or similar device on a motor vehicle on a highway. Noise levels in excess of those adopted by the Administrator under § 22-601 of this title are excessive.
(b) A person may not use on the exhaust or “tail pipe” of a motor vehicle any extension or other device to cause excessive or unusual noise.
(c) (1) No motor vehicle may be operated, nor may the owner or lessee of a motor vehicle permit it to be operated, on any highway in this State unless the engine power and exhaust mechanism is equipped, adjusted, and operated to prevent:
(i) The discharge of clearly visible smoke (comparable to smoke equal to or darker in shade than that designated as No. 1 of the Ringelmann Chart as published by the U.S. Bureau of Mines) in the exhaust emissions within the proximity of the exhaust outlet for more than 10 consecutive seconds; and
(ii) The discharge of smoke from any other part of the engine in such amounts and of such opacity as to partially obscure persons or objects from view.
(2) In this subsection, “smoke” means small gasborne and airborne particles, exclusive of water vapor, from a process of combustion in sufficient numbers to be observable.
(3) A motor vehicle engine may not be allowed to operate for more than 5 consecutive minutes when the vehicle is not in motion, except as follows:
(i) When a vehicle is forced to remain motionless because of traffic conditions or mechanical difficulties over which the operator has no control;
(ii) When it is necessary to operate heating and cooling or auxiliary equipment installed on the vehicle;
(iii) To bring the vehicle to the manufacturer’s recommended operating temperature; or
(iv) When it is necessary to accomplish the intended use of the vehicle.
(4) For a period of 1 year from July 1, 1971, this subsection shall be enforced by issuance of a warning. One year from July 1, 1971, it shall be enforced in the same manner as other violations of this section.
(5) This subsection does not apply to Class L (historic) vehicles.
(d) In this section, “muffler” means a device designed for and effective in reducing noise while permitting the flow of gases.
(e) All mufflers and exhaust pipes carrying exhaust gases from the motor shall be of leakproof construction.


§22–601.
(a) With the endorsement of the Secretary of Transportation and the Secretary of the Environment and after a public hearing following 60 days’ notice, the Administrator shall adopt regulations that establish maximum sound level limits for the operation on the highways in this State of each type of motor vehicle or combination of vehicles.
(b) In establishing limits under this section, the Administrator shall:
(1) Consider any noise emission regulations established under federal law for motor carriers engaged in interstate commerce; and
(2) Set the limits at the most restrictive level that, through the application of the best available technology at a reasonable cost, is consistent with attaining the environmental noise standards adopted by the Department of the Environment.

§22–609.
(a) A person may not modify the exhaust system or any other noise abatement device of a motor vehicle driven or to be driven on any highway in this State in such a way that the noise emitted by the vehicle exceeds that emitted by the vehicle as originally manufactured.
(b) A person may not drive on any highway in this State a motor vehicle with an exhaust system or noise abatement device modified in a way prohibited by subsection (a) of this section.

With all that said ... the fine is a $60.00/no points violation ... you can pay it and continue on as you are, you just have to know you could be cited again for the violation. Or if given an Equipment Repair Order in the future, you may have to fix it to avoid having your registration suspended.

i went to a wendys to eat with some friends. in the parking lot, i parked my car sideways (looking cool). it was about 11 at night, there was probibly 2 other cars in the lot, so i figured itd be alright. so im inside with my friends eating a burger. im sitting next to the window and i look across the street and see a cop sitting in the median of the 4 lane intersection. looked like he was kinda scoping my car out. i turned to my friend ryan and said "watch this cop is ganna pull over here and rip a ticket bc of how im parked". so we got up went out side and we stood there for a minute. i was waiting to see what he wanted to do. i lit up a cig. and wouldnt ya know it? he pulls up behind my car and starts playing on his computer, running my tag.

i told my buddy "i bet you 50 bucks i can get out of this ticket".

so i walk over to his car and i ask "is there something wrong with my car?"



he says im not suppose to be parked like that

i lied my *** off and said "oh sorry sir, i didnt know. i can move it if you want?"

he said (in a real dick head tone) "yea cuz i was just about to write you a ticket"

so he backed up and pulled out. i was curious why he didnt write a ticket to the corvette parked the same way at the discount auto parts next door.

i won 50 bucks tho
