Texas speeding ticket

My friend got a ticket with 35/60 today(23rd). His court date is set to be 1/7/05(!!). Can I claim it invalid and dismiss the ticket?

what do you mean by claiming it as invalid? if you're referring to as contesting the citation...you can. but your friend best to have a prepared legit argument. you'd be suprised how many people contest their tickets with a very weak to useless argument while relying on the officer not showing up.

the date that he signed where he "promise to appear at" is to just for him to show at the court house. i suggest your friend that he appears at the courthouse 7 days before the set date and if its not in the system yet, request to have a copy that you did appear.

I was thinking that if anything appearing on the citation has error in it, the ticket is not a legitimate citation and therefore it can be dismissed by showing it to the clerk. All of my friends has done it, but I just don't know how it works.

The error appeared is the court day, which dated back to the beginning of this year, not the beginning of next year....The officer is making an impossible date for him to show up..

you might want to go to the courthouse and re-check the date.....

if they dismissed it, that's good...

if not..

you better prepare..

maybe his 6's look like 5's lol



i would take a visit to the courthouse and explain your issue with them. i doubt a ticket would be dismissed because an officer made an error with the date. maybe they can dismiss to just not deal with the hassle eh ?

Occifers are human too... They too make mistakes. Very rarely are tickets dismissed as a result of that type of error. Now had he said that your friend was in a blue cavalier when it was an orange focus, that may have been grounds for dismissal, but writing the wrong year? Nah seriously doubt it.
