CA Residents- Refusing to Pop Hood
Hello Everyone
Well, basically, my question is to all California residents. Has anyone out there been asked to pop their hood by an officer and did you refuse?
I've been popped 2x in less than a month (why it hasn't happened sooner, I have no idea, but I think they are just really cracking down, since there is a lot of street racing up here. THAT and I have a freshly installed roll cage. Which, apparently, gets much groupie love from the cops
).
I want to know if anyone has ever been asked to pop their hood by a cop and if you str8 up just said "NO."
My friend is telling me that the next time they ask me, to simply say no. And that if they threaten to impound my car or take it away, to just say, "Why? And on what grounds? I was driving the speed limit. You have no probable cause." Of course, this is given I am driving the speed limit and I am not being a total **** to the cop.
Does anyone know if this will "work" or have you tried it, if so, please share your experiences or if you have any information on my Rights or any legal information, that would be greatly appreciated.

Not bad for a first post. I am in tx, but if I was asked in CA, I would say "No". Its not like the d17 is something special to hide though, might just frustrate the cop bothering you.
What is a first post typically like? haha actually I registered to ask a tech question, but thought I'd go ahead and ask, since I just got back from court.
I admitted to going 80 in a 40 zone and the judge dismissed my "defective exhaust". I think he just didn't want to deal with me and was tired.
As far as saying "No", I think I'll try it... Thanks, guys.

honestly, it varies on the situation.
if you were tagged at the illegal drags, of course they can legally impound your vehicle.
if you give the officer a hard time, he or she will return the favor.
i admit my vehicle does not pass emissions and is a smog polluter and i am in CA, if i were ever asked to pop my hood if they tagged me for window tint, id probably would. they'd only see an short ram intake and maybe my downpipe. easy fix-it tickets...unless i am sent to see the ref
read up on www.dmv.ca.gov on the laws of having to open your hood legally and whatnot. i dont see why not if you have nothing to hide right? let the officer make an @ss of himself/herself when they see that nice plastic black air box of yours

they are only fix-it tickets if they check that box.
Lately everything they have been giving out around here have been non-fix-it tickets. Like my friend who got tickets for window tint, modified intake, and front license plate missing. He had an AEM CAI thats carb legal, and they still gave him a ticket. Also, none of the violations were correctable. He had to pay the tickets off.

hummm... thanks eastbaystunn for the link... I will read that when I'm sober..... well, apparently, the 2nd time I got popped, I was followed on the freeway going the speed limit, by 2 officers... the called another one for backup becoz they were trying to skool a noob..... it turns out the cops diudn't even turn the ticket in, becoz when it came time to pay it, it was not on record... also, put a silencer, front plate, and raised the byitch and state ref wrote it off without even looking at the damm car... i am having a lucky streak so far...... my motor is completely stock for now, just intake/exhaust, but it's really the interior thats killing me.... it may not be a big deal to some of you, the whole fix-it tix thing, but to me it is a complete waste of time to me to drive to the courts and stand in line and bs... so my car is 20 from the headlight and not 22. why is that so bad... please excuse me i've had a couple..where is the martini icon. thank you for your replies!!!!! I think I am going to give it a try, even still

not a good idea to have anything illegal in ca. The only part of a car that a cop can not search without a warrant is the glovebox. pop open the hood or your car is going to get towed.
oh yeah, and turbo in california on a d17 is a bad thing unless you don't mind breaking laws.

Im sorry to Rebuttle But This Is and untrue statement. It works like this.. . An Officer will ASK to search your car. He will more than likley say somthing like. "Do you have any Narcotics in the Vehical?" at wich point you say "no Sr." and then he'll reply. "Would you mind if i looked". NOW THIS IS THE KEY!!!!. When he askes this question. You can say "You may Search for Narcotics.". Now.. say you have a loaded Uzi under the seat ( i know i know but its just an example of somthin other than what was stated). If the officer finds the uzi. and Arrests you.. you can Contest the Charge.Because You ONLY gave The OFFICE PERMISION TO SEARCH FOR NARCOTICS.. Meaning. ANYTHING ELES HE FINDS he Does not Have Permision to look for.. It works the Same as a warrent.. Warrents MUST BE Suspific. and anything found that is not coverd in the warrent.. must be attained with a new warrent governing the search for such items... YOU muST BE SPECIFIC ON WHAT YOU GIVE PERMiSON TO LOOK FOR.!!

I had plans to boost, about a year ago, but I have since then changed my mind and decided to go N/A. This being my first Project Car, I realized that I want to really make the most of the EM1 and do things like maybe LSD and upgrade some Japanese parts, but to just do somethings to really bring out the most in this motor, otherwise I'd have gotten motor swap or boost. My goal with this car isn't so much, super-fast-****ing-car, otherwise it'd be on the track and not my daily driver, but this is all a process and a fun *** project, but very ****ing expensive, but it's cool. I'm having fun
I'm not so sure about the uzi example! Many (if not most) police agencies / jurisdictions these days do have provisions in place for situations where they were legally permitted and/or warranted to look for one illegal thing but find a different illegal thing along the way. Best bet is leave the uzi at home! 
As for whether you can say "no" to popping your hood, I don't know, but I do know this, even if you can, it would probably not be worth doing! It doesn't really matter in reality whether you have that right or not, he would just FIND ANOTHER reason (or reasons) to bust you on the spot, and there are infinite reasons one can get busted (most of them ridiculous but legal nonetheless).
If you give a cop on the side of the road long enough, he could find at least 3 things to write up on your grandma's car! Especially if he's not in a good mood, and most cops who have gone to the trouble to pull you over won't respond kindly to being told "no" even if you have the right. Tends to be seen as a challenge. Cops don't like being challenged
If they can impound you they probably would and if they can't they'd just have at your car and you with a fine tooth comb until they come up with something else to nail you with.

EXACTLY. hahaha *sigh* I know this, I was just hoping someone could tell me different (wishfull thinking).
I got pulled over yesterday night, in front of the house. Moms even came outside.
The cop said that they "put the speed bumps there for a reason"
He kept repeating that, and it was getting on my nerves.
He didn't like the way I was going sideways, becoz my car is dumped.
I didn't even try to explain why I was going at an angle becoz the car is lowered.... I just appologized. Then he went on to say I'm not supposed to be all in the bike lane and he could've wrote me up etc etc...
But basically, if it's not one thing, it's another.. UGH
