engine searches
in the last couple of days the police in my area have been trying to cut down on street racing...so they have targeted anyone that has a modified exhaust...they have been pulling them over and popping the hood and taking pictures of the engine and giving out tickets...is this legal? don't they need a warrant for a search like that?

In my opinion, they would need probable cause to pop your hood. It's the same as popping your trunk to look for something. Don't let them do it, especially to take pictures. Thats just my opinion.

it's in the orange county area....it's part of some sting operation the police did...almost everyone with a modified exhaust was pulled over and they had their hoods popped open to check for illegal modifications...a lot of people that i know of with jdm swaps got in serious trouble

i talked to a lawyer friend i have and he said that if they have probable cause then they can pop your hood...but it's what they think is probable cause...and since california emissions are gay...having a modified exhaust could mean you have other modifications to your engine...so they are saying that that is their probable cause

Either way your screwed, if they ask u to pop ur hood ur screwed and if you say no then they know ur hiding something. Cops don't go for the murderers, rapists, and thieves no more...they go for the rice pple now.
there is a artical about this in the last import tuner mag. It tells about what the damn cops are up to and also what you can do. It is BULLSHIT and we should not let this happen. I guess the best thing that we as a group that shares similar intrests could do is write letters to people in congress. Not that it would do any good

they can't pop your hood without probable cause. And the probable cause needs to come before they "ask" to pop your hood. If they ASK, you say no ... and then they are not allowed to then say "I have probable cause".
If they SAY pop your hood and if they ASK to pop your hood ... those are two different things.
As for probable cause, they can nail you for the exhaust, but not sure about the engine

i read that article in tuner mag. it also has the one about Mr. Ticket. he's the one to go to if u get screwed with some bs like that. great article btw

cops in phoenix pull you over only if you have blue lights, peel out, do things you shouldnt (other than parts) But if you have illegal tint, and some other things they see, they will be searching your car. THey are very good about it here, and wont ask to search for no reason. I told them no when they wanted to search at school because they saw roaches in my car (joint roaches), and I said it is rolled cigarettes. They got me with No tobacco school zone, so they found my shyt. Unless they really know they have cause they dont ask for no reason (from what Ive seen 15+ pullovers)
