Most expensive bottle of Sobe
I just had the most expensive bottle of Sobe last night. Went to the Shell station where all the local racers hang out to get some Sobe and see if my friends were there. Just after I walk out of the Shell the CSPD(Colorado Springs Police) shows up and tells everyone to leave because it is loitering unless you are making a purchase. Naturally I took the turn around at the mall like everybody else to get back on Academy Blvd(The main road) and go home. 3-4 Cops jump into the turn lane with everyone else and start pulling people over myself included. To make a long story short I got ticketed for having a modified exhaust even though I have the silencer installed. The ticket is $60 or I can go to city court to fight it on the 27th. I'm thinking I'll fight it. The officer did not measure my exhaust note with a db meter so he has no way of making a comparison against the factory muffler. Here's what the city statute states on exhaust.
10.22.204: EXHAUST SYSTEMS:
Every motor vehicle shall at all times be equipped with an adequate exhaust system in constant operation and properly maintained to prevent any excessive or unusual noise, smoke or flame, and no person shall operate a motor vehicle within the City which is not so equipped, or is equipped with a muffler cutoff, bypass or similar device. It shall be unlawful for any person to operate a motor vehicle with an exhaust system that has been modified in a manner which amplifies or increases the noise emitted above that emitted by the exhaust system originally installed on the vehicle, and the original exhaust system shall comply with all the requirements of this section. (Ord. 98-248; Ord. 01-42)

Thats the same way the Youngsville, Louisiana law is (where I got my modded exhaust ticket)
1st you'll want to argue that no one has proven that your exhaust is louder than a stock civic exhaust. And the officers ears are not an acoustic measuring device so don't let them try to pass it off as it in court.
They cannot make you pay until they have proven that your exhaust is louder than stock.
So they either A) Drop it, or B) Prove its louder and continue on with the case.
so now that they've proven that your louder than stock you could argue that while you are infact louder than the whisper quite stock civic, you are below all local noise ordinances. It doesn't make sense to say that your exhaust has to be whisper quite while any other part of the car (bass, intake, turbo etc etc) can be as loud as your local noise ordinances allow.
And as you last resort you can argue that while you are louder than a stock civic you are still quitier than alot of the stock sports cars out there.

as quoted:
They specify testing procedures for motor vehicle exhaust noise alone (as opposed to total vehicle noise). This procedure specifies a limit of 95 dB(A) measured 20 inches from the exhaust pipe outlet with the engine operating in neutral, typically at a speed of 3000-5000 rpm. (For comparison, a modern rotary lawn mower with a 5-horsepower Briggs & Stratton engine typically emits approximately 93 dB(A) at the same distance at full speed under no load.) It applies only to passenger vehicles. It does not apply to motorcycles or to vehicles over 6000 pounds gross weight.

Well unfortunately I work on the 27th and my boss has college at the same time as court so I won't be able to leave the office. Guess I have to pay the stupid ticket. And to make things even more crazy in this town the police are charging a $30 inprocessing fee if you get arrested and go to jail.

dude best bet would be to pay it or change it. They can easily go outside and make you start your car and rev it and tell you that it is louder than stock.

It really helps when you know the law. You wont just give in to those ridiculous tickets.
3 speeding tickets : I won the case
1 carpool ticket: I won the case
All of which, without even going to the court.

Dude, take the money with you to court. Ask if you can appeal, if not pay the damn fine and leave. Just be nice about it. I put a header on my car from the I have 2.5" piping all the way to a straight through muffler with the baffle out. Never pulled over for it. My car is loud as f*@K, just watch for cops next time. and shift at 2000-2500 to keep it low around cops.
