This is a little hard to explain so I'll try my best.
Lets say that the North/South street is intersected by a East/West street. In the intersection is a light. When coming from the North, that side has two lanes, but after passing the intersection, there are three lanes (which is caused by the addition of one lane after the intersection). So my question is, is it legal to use the shoulder of the right-most lane (while there are still two lanes) before it becomes three and automatically go into the new third lane after passing the intersection?

depend where you reside i guess, but in most states use of the shoulder is prohibited. there are exceptions however, i know in massachusetts, you can use the shoulder on the mass pike during peak rush hours. i would advise against it.
you can only use that lane if you were coming from the east and had to make a right hand turn into the new third lane. you cant change lanes through the intersection you have to do it before or after using a turn signal. Did you get a ticket? My buddy got one a few months ago and lost in court.
I didn't get a ticket but I got ticked off. I made a picture to more clearly show the situation.
I am shown as blue and the other car is shown as red. I needed to turn into a place after passing the intersection but the red car used the right shoulder to go into the new lane causing me not to be able to change lane and turn.

No the Red car cant do that by law...the additional lane is there for right turning traffic so the new northbound drivers can merge into traffic after the turn.
Ok, I lied. It wasn't just one "red" car, it was several cars. It's been happening more and more frequent now with more people lining up there to go into the new lane causing people who want to turn right not be able to turn. When traffic is a bit busy and the line for the red light is long, those people would use the shoulder for as far back as 200m and run up to the light. I just wonder why there aren't any cops there to get those people. It would be a huge money pot. The average number of those people has increased from about 2 per red light to 5 now.
