Got a Ticket!

Ok guys help me out Im kinda confused....I left the muffler shop today to get a new cat on my car but I still have tanabe exhaust on my car, anyways about 5 mins after leaving the shop a cop pulls me over for my exhaust being to loud, so im not sweating it b.c. im thinkin ah watever 10 bux and its over....well he brings me the ticket looks under my car and says "hey everything is there, the cat etc" so im like yeah i know is stock basically except the muffler so he stops and thinks to himself ok whatever...so right when i was about to sign the ticket i notice the "CORRECTABLE VIOLATION BOX was marked "NO" " so at this point I ask him how come it says no? I thought it was just a fix it ticket? and hes like no modified exhaust are not fix it tickets so im like uhh ok so this means this is going on my dmv record? i told him i cant afford to get a point on my record cus i have had my license suspended b4 and im still on probation and i cant get a ticket. He tells me dont worry about it, he said ever though its marked no it wont go on my record...im like uhh are u sure? and hes like yeah this ticket is not a fix it ticket but its not a moving violation...he said they have tickets that are marked "no" that give points and tickets marked "no" that dont give points. Ive never heard of this in my life, i jus thought as long as it was marked no its obviously a moving violation meaning ill get a point on my dmv record. i tried to contact courts but they never pick up, so what do u guys think? will i get a point?

You won't get a point because it's not a moving violation. What did you get a ticket for, loud exhaust?

Yeah loud exhaust, yeah i went to the police station and the lady told me its checked no b.c. its not correctable and I will have to pay full bail but its also not a fix it ticket, she said its in between...she said dont worry its not considered a moving violation and jus cus its checked no doesnt mean ill get a point....hopefully shes right, but so far makes sense cus i dont see how someone could get a point for something so dumb like loud exhaust lol.

How is it not fixable? Sometimes people are really stupid about this stuff. I think the cop was just really bored or something.

put back ur original cat, go to sema's website, email them for a decible rating place and get it tested then go to court and biatch slap the judge with the 95 db. and get ur money back

This is from the Cali statutes:

27150.2. (a) Stations providing referee functions pursuant to
Section 44036 of the Health and Safety Code shall provide for the
testing of vehicular exhaust systems and the issuance of certificates
of compliance only for those vehicles that have received a citation
for a violation of Section 27150 or 27151.
(b) A certificate of compliance for a vehicular exhaust system
shall be issued pursuant to subdivision (a) if the vehicle complies
with Sections 27150 and 27151. Exhaust systems installed on motor
vehicles, other than motorcycles, with a manufacturer's gross vehicle
weight rating of less than 6,000 pounds comply with Sections 27150
and 27151 if they emit no more than 95 dbA when tested in accordance
with Society of Automotive Engineers Standard J1169 May 1998.


Just for your reference needs...check the db level of that muffler and you may be able to have it dropped.

Well I dont mind paying as long as I dont get a point on my record cus Im still on probation from my suspension, meaning I cant get a ticket yet...so from what im understanding im not getting a point on my record. Also had a ?....the last time I got a ticket was last week of July 2002, so for example if for some reason this does qualify as a point which I hope it doesnt will i qualify for traffic school? b.c. January 2004 which is right now is 18 months exactly except it wont be 18 months until about 2 more weeks, so is it 18 months from the cited day? or 18 months from the day the ticket is due? b.c. if its 18 months from day I got cited id outta luck for 2 weeks or so. but if anyone can clear it up for me about the traffic school situation and also if im getting a point or not, just dont wanna have my license suspended again for something soooo stupid.

I dont think you'll get points because it isn't a moving violation...you dont get points for parking tickets, cracked windshields, broken tailights, etc...

Call the court thats sited on the ticket and ask them about the traffic school thing...they can answer any other questions you have.

They said I could do traffic school for my speeding ticket, since I didn't have any others in the past 3 years! And I think you can only do traffic school one time.

I called DMV you can do traffic school as many times as you want as long as it hasnt been 18 months since the previous ticket. The dmv lady told me its not a moving violation, even though its checked no, just means its not a small $10 fine its a full bail of like $75 or something...

Then you should be good to go...now, the only reason to attend traffic school is to get points taken off your record. You're not getting any points so you dont have to go. AND, $75 is cheaper than traffic school would be anyway....just pay it unless you wanna challenge the db level.
