Any way to fight this?
Any way to fight this?
i caught a ticket for parking in a handicap spot with no visible permit, but i swear i ain't see it...
then when i backed out i saw a little wheelchair painted on the floor, but the sign was a lil off to the left, so i assumed it was the pertaining to the the left space...
this is a $130 matter!

I dont think there is anyway of getting out of it. The only thing I can think of is, if you do take it to court, hopefully the cop doesnt show up for 2 hrs, then you get off the hook. If he does show up, then your assed out lol. But hey, theres a chance he might not. I know mine didnt and I didnt have to pay for the ticket

You can do what JayFReaZy suggested about hoping the cop doesnt show but you're better of just paying it. Whether you're serious about not seeing it or not, the judge has heard it all before.

If you wanted to fight it (and you strongly believe that handicap markings were not clear), take pics of it and take it to court. My friend did that and they dismissed his ticket. But from what it sounds from your post, you don't have much of a chance
I'm unaware of the specifics of NY parking laws but in CA it isn't the blue paint that makes it a handicap spot but rather it's the sign. Paint with no sign is not a valid handicap spot. Park there all day if you'd like.
In this case was there a handicap parking space next to you? If so, then you might argue that each space needs a separate sign. Take pictures.
On the other hand, if the sign was off center from where you parked by more than a few inches then you have a much better argument that the sign was meant for the other space. Keep in mind that in CA it's the sign that matters most.
As with real estate, it comes down to location, location, location!
Good luck!
