advice on a totaled auto
Long story short, wife left me & our kids, I refused to pay for her auto/insurance, then she totaled it, being I consigned, she refuses to pay anything knowing I will due to credit, appears court sticking me with the car, 2005 Mazda Tribute owe around $19,000. Anyone know of anything else I can do besides 1. pay 5 more years, 2. bankruptcy. Mazda appears going to let me keep the car to piece out or whatever, but probably wont get much, anyone know of maybe dealerships doing trade ins or something? Maybe, if the car is yours, and she was driving it, you could say she was driving it without your permission. Hence the charges for the car fall on her because she basically stole the car. You can also say she was willfully driving without insurance. Not sure, you need a laywer.

Problem here is that (to my knowlage) is that she has only left, they havent gotten divorced... so to the state, and every one else, they are still married so that makes him liable for half of any of her debts and what not....
you did get a Joint Preliminary Injunction right? other wise she can start lines of credit in which you are also liable for....
Sadly, I think your going to get screwed here, From being privy to four divorces this year I've learned quite a bit about the procedure.

Bankruptcy should be your last option. You could fix the car and try to sell it. Or else pay the payments. Bankruptcy will take care of it but you won't be able to get credit anywhere for anything. Go to a lawyer, see what he says first. then go from there.

you cosigned for the car so it's like you were behind the wheel when the accident happend. Theres pretty much nothing you can do about it. Another thing is, you guys are still married technically and the car is also cosigned under her name as well. Therefore if your payments become delinquent (sp?) then her credit goes down the hole as well...
