WTF! A Summons for my TCS!!

I was just cruising, minding my own business passing the cops. They put the lights on me and i pull over. They ask for the usual and I gave it to them no problem. After about 20 mins, they told me that I've been summoned for my exhaust. They said it's illegal to have a modified exhaust and to not pay a fine, I have to put back on the OEM and take it to the precint. I looked at the ticket and they wrote "Loud Muffler" not "illegal exhaust". Anyways, I doubt that I'll go back to OEM, anyone know what the fine is? There was no price on the summon, it just said, if I decide to plead guilty, I would have to stand before a judge or whatever. Anyways, it really sucks to get a ticket for my TCS and it's not even that loud.

call up DC and get the proof that the exhaust is 50 state legal and meets ALL decibel laws. It is legal in all states.

vellvic.. i got pulled over about a week ago in queens and i got the same deal .. i told it was legal all 50 states.. and then he told me the it illegal to modifiy a exhaust, lights, ..the ****ing cop wanted to give a ticket for everything.. but he only gave me a tickect for the tint.. i was happy.. nypd.. NEWYORKPRICKS****S

many exhausts can say they are legal based on decibel level laws. but in most states it is illegal to midify your exhaust from stock, so yes the police are enforcing a valid law not driving around trying to **** you off. as much as you wish that was the truth.

Damn that sucks. I'm positive the tcs exhaust meets all the decibel laws. I've never heard of a law that says its illegal to modify an exhaust. Good luck with going to court.

It is illegal to modify an exhaust in Virginia. There's a law somewhere about it, but that's for VA. I don't know about NY, but it may be the same case there. I remember when I was getting my license, the cop was like "no big mufflers that are like 2-3" wide." I was about to say that the EVO 8 came with a 2.5" (is that right??) exhaust, but then he woulda not given me my license.

times be equipped with an adequate muffler and exhaust system in
constant operation and properly maintained to prevent any excessive or
unusual noise and no such muffler or exhaust system shall be equipped
with a cut-out, bypass, or similar device. No person shall modify the
muffler or exhaust system of a motor vehicle in a manner which will
amplify or increase the noise emitted by the motor or exhaust system of
such vehicle above that emitted by the muffler or exhaust system
originally installed on the vehicle and such original muffler and
exhaust system shall comply with all the requirements of this section.

seems like if any aftermarket exhaust is louder than stock, its illegal. . Cops have tailed me b4, but never gave me a ticket. My HKS is very low, and you can barely here it sometimes. O well, :knock on wood:, thank god I havnt got that ticket yet. I've gotten a summons for my system, but it was dismissed 1 week b4 trial date. They'll probably do the same thing to you if its ur first offense. My boy got a ticket for his exhaust, and it was dismised 1 week b4 trial too. Good luck bro

That seems reasonable. This blabber about not being able to modify your exhaust would mean that if your muffler was ripped off by a pothole you would have to purchase a Honda muffler and not go to Meineke and get one since it's not stock. However, the way the law reads is what I expeted from our great legal minds.

I've never heard that it's illegal to modify the exhaust. I see big exhausts every day here, and there shouldn't be a problem since almost all are carb legal. Cops are getting stupider everyday. They can't catch us racing, so they have to resort to ticketing everything that's different on the car.

I got a ticket too for my tcs and i went to court with a paper that said it was 50 state legel. He didn't even look at the paper and and showed me the law book and told that every aftermarket exhaust is illegal. so i paid the ticket and he told me that i can get another one once i leave the parking lot.

What an a$$hole. If EVERY aftermarket exhaust is illegal, why does almost EVERY auto-part, car accessory, or any car-related store in NY sell them? WTF is the point? If its for "show purposes only", thats bullshit. I can fckin have marijuana and coke for "show purposes only" and not use them if I didnt want to, but you dont see drug stores selling them. If they are illegal, tell the cops to go to the stores and have them confiscate all exhausts from auto-part stores. I swear, fcukin pigs have nothing better to do but sit on their asses and give out tickets. Then for the judge/cop to say something immature like that, was just a typical pigheaded move. argggg, pigs **** me off. (just venting a lil, lol).

it was his assistant that didn't like me because when he showed me the book and didn't care about the 50 state legal paper i got mad. then i said screw it i'll just pay the ticket and asked him how much he told me it can either be over 100 or up to time in jail. I think he was trying to scare me because i think i only paid 50 bucks

I got pulled over for that in NY a few weeks ago. I told the cop that its carb legal and Ive had it for 3 years so im not in violation of the recent laws and he bought it. He told me to watch out and in NY for having mods on my ride. Soon it will be illegal to modify your exhaust in any way, including a chrome tip. I guess a lot of car dealers are lobbying to have modding in any way made illegal for some reason, most likely sales or some money crap.

That's wierd because everytime I go to NYC everybody has a aftermarket muffler. I saw a minivan once with one. The cops just go after the nicer looking cars I guess.

i agree cops shouldn't be able to ticket anything thats not stock, because midas/meinike/sears or whever you get a muffler repaired at.. thats not stock parts its their crappy parts.

They just need a reciept saying stock exhaust put back on, so hopefully you know someone who can hook u up.

Then after you get out of court go put your exhaust back on.......LOL

I love the crack down on import exhausts, but absolutely nothing is done when harley davidson's come ROARING through the streeets. Some of those exhausts are re-goddam-diculous.

I've been bitchin about the Harleys for a while now and I'm sick of them getting off without and hassle. Like the cops are afraid to pull 'em over or something. Well guess what, this is the year 2004 and in my city anyway, 95% of the Harley owners are 45 year old Techology geeks with too much money and a mid life crisis.
I'm gonna take aim at that bastard on my street soon next time he runs his s.hit box bike down my street at 3am

I worked out at Ballys Total Fitness yesterday with a Maryland State Trooper and asked him about this exhaust problem. He said Maryland State law is very subjective and it says that you cant add a muffler to your car that is louder then stock. Soooo, that means if you add an aftermarket muffler to your to increase performance its legal as long as the sound is not louder then stock. The reason its subjective is because if you take a mustang for instance which already has a loud rumbling muffler from the factory, its really up to the cop at that point to decide if its louder then the stock muffler. That puts the responsibility on the cop. Cops cant tell the difference between a couple decibels but there can tell the difference between anything above a certain amount of decibels. Honda Civic mufflers are not loud from the factory and thus in a way were punished with not being able to modify our mufflers because of this. Meaning a Stock Mustang Cobra can make more noise then a modified Honda Civic, yet we are the ones breaking the law. Go figure.

Hopefully after you put your aftermarket exhaust back on they dont stop you again, because then you will have to change exhausts again. This is just a case of where we have a stupid law. They should make a level of sound we all have to abide by whether adding mufflers to our cars or getting Stock Mufflers from factory. Harleys are loud as hell (as stated above). We have this ******* who lives in my neighborhood with a huge 1500cc motor in his motorcycle. When he comes home late (11pm or so Monday - Friday), he wakes up most of the neighbors.

I have been pulled over 2 times and got out of it. Once by the DEP police and he said it was like a 500 enviromental fine. I was nice and in my suit from work, gave him the 50 state rap (mine is custom so it is not) and he let me go. Talked my way out of the other one because they pulled me over for no seatbelt and I had it on, so they were just trying to harass. I called my cop friend on my cell and he took care of it.

One of my friends got one, went to a mechanic friend, he gave him a receipt for a new "Stock" exhaust. He took it to court and got off. Most violations like that are waived if it is fixed.
