Damn CHP

ok, so chp pulls me over when i'm going 75 on my way home from the dealership after picking up my car. so the guy comes up and says i was going too fast. people were passing me the whole drive. so he writes me a ticket for doing 80 in a 65. so i asked to see the calibration record for his radar and he says "i don't use radar, EVER!" he's shouting this at me. so i ask how he got my speed and he said that when he pulled up next to me his speedometer read 80, so i ask to see the calibration record for his speedometer. he yells at me that he doesn't have to show me that, so i just say fine, i'll see you in court. so i start up my car, and then he yells "STOP THE CAR! YOU HAVE MODIFIED EXHAUST!!!" so he takes back my ticket that i already signed and writes me up for that too.

so anyways, i'm looking for something that says that he has to show me the calibration records at the scene so i can get that one taken off. and i don't even know what type of exhaust i have, so what do i do for that? any help at all would be awesome.

I'm not sure if they're required to show you anything at the scene. I know in New York, I don't have to show anything, but I am not familiar with California laws.

i dont think you'll get away with the speeding one. i dont think they have to show u a reading. dunno about the exhaust tho. just go to traffic school

next time, just take it to court without being an *** to the cop. even if you feel that you have been wronged, it's not a good idea.

Ask quicksilver or injencivic about the laws on radar detectors and speedometer calibration and if the police are required to show proof at the scene. I would fight it though, he probably won't even show up in court.

A CHP officer will show up at court. Their jobs are to issue traffic summonses, that's it. If you have a clean record w/ no priors, you should be able to work something decent out.

I looked up your car under members rides and I dont see any exhaust listed so I guess your exhaist is stock but according to the patrolman, the stock exhaust is "modified". Some cops should of wrote this one kid up at my old high school, this guy had a modified exhaust that was LOUDDDD and he had it for a while. So you get written up for going 80 in a 65, when you go to court tell him to check out the San Diego freeways. Im telling you they got people going faster than 80 and I rarely see CHP on the freeway. Hopefully things will go smoothly and wont be such a pain in the [IMG]i/expressions/moon.gif[/IMG]

You shouldn't have to prove it, just tell the judge what he said. Remember, anything you say can or will be used in a court of law, same goes for them.

A modified exhaust is completely legal as long as the noise level is under 80db.

If the cop doesn't show up ya, you're pretty much off the hook, but in BC the cops don't have to show you anything. They can pull you over just because they estimate you're going faster than the speed limit and by doing the distance over X seconds they can figure out how fast you're going. It's pretty simple.

If you're exhaust is stock, don't worry about it, but if you've changed it in anyway, the court might have you go get your car inspected.

I don't know what it is called but here in wisconsin if you go to court to fight a speeding ticket you can file a motion that requires the officer to provide his calibration records. If he can't or they are incomplete the charges are dismissed. Ask the court clerk about it.? hope this helps. As for the exhaust if you meet emissions standards for your state and you aren't louder than the federal 90 decibel sound limit I don't see why you should have any problem. I think the officer was a little upset that you challenged him at the scene and then decided to give you the ticket for the exhaust.So if you are inside the law no harm no foul. Later

Wow that really sucks. Going 75.... I rarely go below 75 at a 65 zone when traffic is smooth. I go at the flow of traffic, which is usually 80 in LA.

But bay area, everybody drives slower, so I can't drive above 70 without fear of getting pulled over.

This would be a good Idea. However, you've already been caught so....

As long as your exhaust is CARB legal and under 80 dB then you won't have a problem. If it's stock then that's even better. If not you're going to have to go have the sound measured and provide proof it's CARB legal.

As for the speeding, if he didn't use RADAR than you're pretty much screwed. You can try and argue to the judge that his spedo might be just as uncalibrated as yours could be. There is a generally accepted measure of +/- 10% of the speed given as for calibration errors. Assuming his is 10% hi @80 (8MPH) and yours is 10% low @ 65 (6.5) Then you were going 72MPH. Still speading but not at 80 as claimed. The judge will probably look at you like you're a moron, but it's worth a try.

But its worth a try to show what the average speed people are doing there, if he's in an area where people generally go fast. A person I knew told the court that the flow of traffic is high there, they investigated and found that the average speed was around the same speed the person was going, and let him off.

If your car not stock (even just rims) chances are cops will come after you with a vengeance. They'll profile you as being a ricer who likes speeding and taking risks.

Yup. A police car has a "certified" speedometer which allows you to pace someone to determine the correct speed at which they are traveling.
