Got in accident, now civic rear end is totaled!!!(pretty long story)

Got in accident, now civic rear end is totaled!!!(pretty long story)

Ok i was with my friend Jen and my brother looking for a car to buy for jen cause her parents are buying her a car for getting into governer school which is hard to get into. Well we stopped at a couple places, took a look at a few ludes , few vics, few integras, and a few other nice cars. Well after stopping at two places we decided to head to the big city where theres alot of nice used car lots.

Well we were in the middle of traffic which was stop and go. There was no one behind me and there was a truck infront of me while i was at a complete stop. Friends and i were talking then all of a sudden BAM!!! i had the brake on and i skid a few feet. I felt the headrest pushin pushin into the back of my neck. I was dazed for like a min then i pulled the car to the side of the road. My friends and i got out and the couple which had hit me from behind got out also. It was a bunch of old people driving a Green buick.

I work at the hospital as a nursing assistant so i went and checked if everyone was ok. Everyone in my car got whiplash but i got it really bad cause i felt dizzy and my neck throbbed. next i checked the old couple the woman was ok but the guy had lacerations on his left wrist i dunno where from. I know i wasn't suppose to move but i had to check on everyone else.

This volunteer fireman came to our rescue and directed traffic and called the state police for us. He also called in an emt which came ten minutes later. I was the only one taken to the hospital cause my neck throbbed really bad and i wanted to get it checked out. I spent 3 hours in the ER laying on those very uncomfortable stretcher imobilizers which suxed before they took for me x rays. I pulled a muscle behind my neck as a result to whiplash but hey atleast i get a few days off of work now.

As a result of the accident the trunk is totally destroyed since its bent inward/ up, My altezza tail lights are cracked and the screws are almost ripped out, my Buddyclub rear bumper is scraped really bad and a couple of cracks no doubt since its fiberglass(oh well it wasn't my fault).

To top it all off the old couple lied to the police and told them they were tailgating me which was not true. They were going atleast 30-35 mph cause they hit me pretty hard and tore my whole rear end up. Im really upset right now and i am definitly gonna sue them cause now i gotta waste all my time with insurance, repairs, my unecessary neck injury and time off of work. Also i gotta get a new rear Buddy club bumper, get it painted and get it installed and it took me a long time to get the kit in the first place. Its so much of a waste of time and now i want compensation. Sorry this story is long. Im just upset now cause i gotta waste all this time to get repairs and now im just venting. Hope you all had a better day than i have peace.

I'm sorry to hear all that. At least you aren't hurt bad. I had a similar accident about 2 years ago. My BF and I were on our way to get him a new car and someone ran into the side of my car and totalled it. It terrible to go through, but everything will work out. damn man sorry to hear that. its a hassle to get the car fixed cuz u have to be without it for a couple of days. at least ur ok and thats the most important part.

Telling the officer they were tailgating you should have resulted in the issuance of a summons to them for following too closely. Tailgating is certainly very illegal. I too am tired of the persistant inattentiveness of elderly motorists, so I'd say go to town with them. Make a claim against *their* insurance, as their vehicle contacted yours and also put your injuries through *their* personal injury policy. That will sure screw their insurance up.

Yeah im glad everyone was ok and im really glad my brother and my friend Jen were ok otherwise i would really be upset if anything happened to them.

Yeah my brother told me they got cited and that they lied to the police. But hopefully monday i can get a copy of the police report, call their insurance company, then call an accident lawyer. im also gonna go to most of the collision repair shops and get alot of estimates. plus find out the total estimate for my rear body kit bumper and altezzas. Also i have a question............................Will their insurance pay for my rear body kit bumper and my altezzas cause they are a part of my car which is a part of my property

I've found that for the majority, an elderly motorists head does not turn. It's interesting to watch them execute a turn, as it is usually the case that you turn your head to look in the direction you are turning. Elderly motorists also frequently travel in reverse without checking their blind spots or looking behind them. The elderly operator usually enjoys having an intent conversation with all occupants in the vehicle, and that usually will serve as a distraction.

I'm not sure about the specific insurance regulations for your state, but I know in my state, a persons insurance covers damages and injuries to anyone in the car and anyone/anything that the car contacts. I would assume most states are the same and you could yourself put a claim through on the other motorists policy by contacting his insurance company.

That really bites ***, but if everyone in the car got whiplash, I think you'll prolly end up with more than the price of the bumper and insurance to fix everything. It's good to hear that everyone is ok, there are way too many accidents on the roads every day that don't end up quite so fortunate.

Old people are hazards to the road!!!!!.. ALmost every senior that drives here in TORONTO that i have seen are extremely dangerous!..

ONe old lady was driving 60km on a highway that's 100km..... everyone had to change lanes to avoid her.

I don't want to be cruel btu I think the law should make it so that anyone over 65 shouldn't drive.

There's litigation in the makings in several states in the US, the only one that I think passes just made them retake thier tests after 60, dunno about provinces though, there may be. Canada is usually better about passing that sort of stuff than the US, less corruption I suppose. Most of our law makers would be "inconvienenced" by that sort of law though.

correct me if im wrong qck but dont police have formulas they use to measure the exact speed of the offender at the time of the accident?? like by measuring the length of the tire marks or by measuring the indentations/markings/scratches on the hit car?
if so that could have helped you at the scene..but i dont know if they could still use that against the dumbass people
sorry to hear about your accident..and about your bc bumper..from what ive seen they are hard to find. at least around here they are..

We only really do that for serious personal injury/death cases where a police investigation is needed. We don't do that for property damage cases and minor PI instances. But yes, there is a machine that will measure the marks to estimate a speed.

Their insurance agent just called me and they told me that they will repair everything and all the damages. Plus my insurance has to pay for my medical bills and my friends, but they will pay back my company later on. Also they said that since i got full coverage on my car. I am intitled to pain and suffering fees. I'm still upset cause my car is totally messed up and the doors are not aligned correct. I think they might have to put a new quarter panel.

If i take my car tommorrow to the adjuster and they declare it totaled. i might just get a new one and trade it back in and get my money back. I have my eye on this red 93 RX-7 twin turbo that is for sale close to my house just the same price as the vic. I love the vic so this is a hard decision. Im a very safe and cautious driver so don't think that im gonna buy the rx-7 and drive it like crazy. But i hope my vic will be okay cause i love my car. My friend got 40 grand because he got into an accident and it messed up his neck real bad which was unrepairable. So i hope that doesn't happen to me cause i don't want any problems later in life. My neck still hurts after lot of pain meds and ben gay.

Your insurance carrier will most certainly declare it a total if they deem that they would end up spending more repairing it than what the current value of the vehicle is. As for the pain and suffering fees, take it if you can get it. Here in New York, you can't generally even sue someone for injuries from a car accident because the courts are so backed up. That's why there is No-Fault Insurance in New York (and California) which instantly pays for all injuries no questions asked and then allows the insurance agencies to sue each other to get the money back. You are only entitled to pain and suffering and money for injuries (in New York) if you have "permanent and significant" injuries. That would be something like losing an arm, or leg or being deformed, something very serious and a lifelong injury. So, if you are being offered pain and suffering, take it.

Glad you're still living and breathing, and hope your neck feels better soon.

Older folks are hazards. My 72 year old grandfather was in a fender bender a copule months ago. It was his first car accident in his life. Thank God it was only a fender bender. He imediatly decided to stop driving. I'm glad he volantarily made that choice. Now he is safe, as are the other drivers on the road.

man i hate old people who drive. When i had my old eclipse i was stoped at a light, a normal routine stop, was there for like 20 seconds and the next thing i know i hear tire's squealing and BAM!! i was hit. i got out my car and the guy is so close to the steering wheel his chest is touching it. i asked him if he was ok and he said yes. then i looked at my car and it was barely damaged, a couple scratches, and looked at his car and it was screwed up. bumper pushed in, headlights cracked, the whole nine. he asked me if my "vehicle" was ok, and i said yes and then asked me about his car and i told him it was fine, and i drove off. i don't need points on my insurence cause of a dumb old person, i dont care if its leaveing the site of a accident, it wasn't my fault

OUCH hell yea sew them ****'s old people are careless, i live in a mainly retirement city, around two air force bases, theres crown vics and caddy's hitting each other ever day, old poeple, the best thing i saw was a cadillac and a lesabre hit each other and the two old people went at it in the street, OMFG two old a$$ people duking it out, i didnt help just stopped and laughed.[IMG]i/expressions/demon.gif[/IMG]

Points on YOUR insurance?!?!?! You don't understand the basics of insurance. If he caused the accident, it will not affect your insurance, at all, now if he did not have insurance, that might be a problem, but in ohio, as well as many other states in the US, liability insurance is required. In Ohio, your insurance would pay for the damages, then sue the individual to get the money back (if it was their fault and they had no insurance)

Sorry LJ, you're wrong...your insurance will go up no matter who's at fault in an accident. I was rear-ended once, and now I'm paying out the *** for insurance. Some insurance companies won't even give me insurance because I've been in an accident. Once something touches your car you are considered a "high-risk" driver as they told me.

that's not all, true. It will go up in some places and in others it won't. It all depends on what kind of insurance you have, where u live, the company you have your insurance with, and the severity of the accident.

Well, I had "normal" insurance...now I'm with Geico Casualty. There was no damage to either car...and I'm in CT.

new jersey, where i live, has a no fault law. if your in an acident you get points, unless your not in the car. Reason 649 why New Jersey sucks

No-fault has nothing to do with points. No-fault is known as "PIP" or personal injury protection. It pays for injuries right away, no questions asked, in an effort to reduce the personal injury lawsuits filed by those involved in a motor vehicle accident. It is simply a type of liability insurance for injuries and does not involve DMV or points, etc.

well my insurance will not be effected in any way. In PA your insurance pays for medical damage and their insurance pays for damages to the car. I went to get an estimate today and this guy from comcast cable company was sitting in front of the claim adjuster's office. He laughed and said" Who put on your body kit as a joke". But that pissed me off. The adjuster said it was undriveable and also there would be more damage that he wouldn't be able to figure out. i took it to Honda and they are gonna fix it up for me and send the insurance company a large bill. I went to my aftermarket parts shop and got an estimate for my body kit and tail lights which they said they will replace for me. Right now they gave me a POS sunfire to drive. Lol and it's automatic too. Im so used to driving stick that i kept reaching for the shifter when i was driving back home. Also went to my family doctor and they told me i should be fine in a week or two. Gotta keep heat on my neck to relax the muscle. Im glad my civic isn't totalled and i should be getting it back neck week. The only problem now is that its gonna take a while for my body kit to come in , get it painted and installed. The only thing i will be getting out of this is a check for pain and suffering and i doubt it'll be alot cause after all the repairs
