Traffic Violation Question
Hey,
I got pulled over the other day for running a red light. Now both me and the kid in my car saw that the light was yellow while i was going through it. Normally i would have stopped anyway, but it was wet out and its one of those roads where its kinda confusing on where you stop. I wasnt speeding and i honestly didnt see the light turn red while i was under it. So now im looking at this ticket for 95 dollars. What i want to know, and i would escpecially like some input from the guy one the site thats an officer, what are my chances of getting out of this in court. Any input is appreciated.

Not much. A yellow light technicially directs you to stop if it is safe and prudent to do so. The officer was probably under the impression that you should be driving more cautiously in the rain and therefore should be able to stop the car at a yellow. If on the other hand, if you have a clean record, you could attempt to say that due to the rain, the road was slick and you did not want to risk skidding out of control; this could enable the court to plea the summons down or possibly dismiss it.
Was he behind you when you....ahem ran the red light? If he wasn't he cannot assume you ran the red, he had to have witnessed you from behind you to make it stick. Also, was your car past the limit line when you when through the red? I know here in Cali, if you car is past the limit line (sidewalk line) before the red, you can proceed through the intersection as long as it's safe.

As long as you don't have a record of speeding or other traffic citations, the judge will probably let it go or at least keep the points off. That's assuming you really didn't run the red and the rest of your story can hold up. Worth a try...

Thanks for the quick replies. Heres some more info for you. He was not behind me , he was stoped at the light perpendicular to the one i went through. It was defently yellow when i got past the limit line, assuming the limit line is what i think it is. And also i know this is going to sound bad, but i never get pulled over, but like three weeks ago i got nabbed for speeding for the first time and it just happened to be like three days before my appointment to get my inspection so i got two tickets at one time. Is that going to definatly screw me over in court. Thanks again guys.

Well, there you have it! Your Honor, it was very slick that day, and my car was very close to the limit line when the signal changed yellow, and I didn't want to slam on my brakes, otherwise it would have probably caused my vehicle to slide. I was proceeding through the intersection with caution. Officer blah blah was perpendicular to my vehicle and could not have possibly seen my vehicle in relationship with the light, (your view of the light) and that in fact "I actually Ran a redlight."
