Had a nice wake up call this morning...
5:30 is too early to be woken up...especially when what wakes you up is your car alarm going off.
I jumped out of bed put on my clother and ran downstairs to find a Patrol One pick-up truck in the middle of the road and a tow truck farther down, near my car!!
I yelled out to them asking if they were trying to tow that my car, after the confirmed it I demanded they put my car back. To make a long story short the moron of a rent a cop said that the preiod between parking violations within my complex is 14 days...uhm no..it is 7 days. I furnished proof, he refused to. BTW parking violations would be parking in a "Guest Parking" spot for a total of 72 hours within 7 days. Nomatter where I parked if I parked in guest parking mon, wed, friday. On saturday morning I would have a white slip saying that I would be towed if my car is up in the complex again and parked before next saturday....well the rent a cop stood by the fact that it was 14 days. He was lying out of his *** especially since if that were the case I woulda been towed dozens of times by now...unfortunatly I had to pay 50 bucks to get my car put back. So from here I call my landlord, make sure there was no revision of rules and he hasn;t passed them onto us. If that is the case I take the 50 bucks out of the rent. If there isn't I call the association, the people who contract the security agency, and demand my money back.
If your wondering why i don;t get a different parkign space I'll tell you...the people who designed this place screwed up majorly with the parking space to tenant ratio...think of titanic and her life boats, too many people, not enough boats...especially when people use their garage as storage, which I don't do. We have a two car garage and three car in the house hold...
I got the badge number and phone number of patrol one, and when I was asking this guy to furnish proof that it was a 14 day waiting pewriod he told me that he cant give that to me...He even offered to call the police and have them settle it, but my step dad said no....this is the point he came out with the association rules and regulations. We had proof the security guy didn't....the guy couldn't give any information in regards to the logs of when my car was up in the complex...the guy was a complete hard ***, or trying to be, he loved the power trip...I'm so pissed.....

The assocsiation's records say that the waiting period is 7 days. I called patrol one spoke with the communication officer and his records say it is 14 days. Also that if I want to take Pat. 1 to court they are under contract so they are protected...So I'm concluding that the association will be at fault if
A: They failed to communicate the updated rules to tenants.
B: Their contract was in error on Pat. 1's fault, in which case since it is a contracting company contracting out the security agency they are at fault for any errors the security agency makes. (This one may be a bit schetchy)
Thus in conclusion I may take the claim to small claims and sue for my 50 dollars back, but I'm sure court fees will build up to a lot more..so now my question is can I sue for court fees PLUS my original 50 bucks?
P.S: I know 50 dollars isn;t a lot of money but to a guy who pays for al his own things plus rent each month to his parents while making 7.70/hour + going to school it is a heck of a lot of money....

That is just stupid, just some jelous d*ck that wants to look like a big man. This is the point where I wish I had an air ride suspension so that if I parked anywhere I would just lower the car to be like 1/2" off the ground and then they couldnt do sh*t to tow me.

Hahahaha yeah my friends and I have that problem....lil old rent a try hard cop....who is racist towards my group of asian friends....always kicked us out of the Westmount mall when we went to go eat....and well because we like to hang around one table and well talk instead of yelling accross the whole food court....some of us would stand and smoke and the others like me would sit and wel eat....haha...This guy...would kick us out for standing and not sitting....I would be eating my lunch and then I would get kicked out......The *** would do this like everytime we came there.......we would get kicked out everytime...ahhhh sooo mad....and I went to the school across the street at Ross Shep......I hated him...we all did....Then when we got kicked out and banned because of some warning of not following westmount regulations.....because....half of us did not buy food....and some of us did...we got banned...we stood up..and went OFF...we were like you have a problem cuz we are ******...and welll he said no.....and then I said we were not going to move.....and to f#ck off.....cuz we were not doing anything wrong...then well when I said that....he grabed my arm....cuz well I told him to f#ck off like well 3 inches from his face....once he grabed me...I kicked him in the chest.....after..that...about 9 other asians were on him...kicking him in the head and what not....And well we were gone pretty fast....Luckly I didn't get caught...kinda messed since I went to the school next to it...and I haven't been back there since...hahaha...mabey I should go back and pay that attempt a cop a nice visit....

I would have called 911 and requested police assistance. As a police officer, I know that in New York State (as well as most other states, however, laws greatly vary by state) a security guard is a civilian and has no police authority (IE-arrest powers, summons powers, car impound powers). A civilian does not have any power to call a tow truck and request a car be towed, even on private property. Further, the law in New York states that any civilian wishing to tow a car on private property may do so as long as (as was the case in your situation) they FIRST call the police, and determine if it can be lawfully done. Failure to follow this procedure will result in grand larceny charges against the individual(s) taking the car, as technicially they are stealing it. I would certainly follow up with your landlord and also determine if the seizing of your vehicle was done in a lawful manner.

Thank Qcksilver. I'm also gunna consult a few people I know that are rent a cops, even though they aren;t butt heads, also my g/f's family is a family of cops and such. The guy did mention that he had to call in and get authorized to tow the vehicle, but he didn't say who ok'd the tow. If it wasn;t lawfully done then I'm going all out on the association and the company itself, for attempted theft and larceny. I want my money back, but what I really want is the association (which is made up of a bunch of old people with nothing better to do then complain) to stop this parking limit. Even real guests are subject to this punishment....you have someone drive in from arizona and the association want proof tof where they live. This means bills, license, and registration...I however really don;t feel like paying a bunch of money to do this. We'll see what happens though.

Speaking as a police officer that's kind of an ignorant remark, bobbyd. I myself have a Bachelor of Business Administration in Accounting and Management, and do not at all consider myself dumb. Most departments (including mine) require at least a year of college before you can be hired. I can't speak for a rent a cop, because I am not one, however, generalizations regarding a particular group of persons are usually incorrect and should be avoided.

Security agencies generally hire former police and military to work for their companies. But some hire people right off the streets, they kinda have to. One of my friend's dad is a rental cop and he is former military, and LAPD. He's a little odd, but he's really inteligent. It is just those ones that bug that everyone rants about.

Degrees? What does that mean? I have a degree too in construction management and I work with architects all the time with masters and they could not design a shed to save their life. The reason I said most is cause I did not mean all. There are plenty of very smart and legit police officers out there and you seem like one of them. Did not mean to offend anyone. Heh heh. Then I'd get heavily fines for vandalism, and have to pay for repairs...I'd much rather have a company lose it's contract with my association.
