sounds like you need to go to court or arbitration. you wont get **** unless you do....
the cost of pushing you away is nothing with letters and ****, you'll have to pull out the big guns and show them that you will cost them money (legal fees to defend against your claim) to get your point across.

Not only that but the dealer that I get my parts from has a mat on the counter with there hfp sponsored civic drag car. They know that these cars are bought and modded by alot of people. This is imo why scion went with dealer aftermarket parts that will not void a warranty. I think its the smartest thing a import car builder could have done. Not only do you feel like you are not wrong in creating a different car in a way but now you do not have to hide it. Honestly i think honda did this just to weed out those who are not willing to fight it. Like 3 of 10 maybe wise enough to fight it but the rest of them they get to weasel out of paying any thing. Btw slow gold stick it to em buddy and get your money back!

I just got off the phone with them A$$holes from honda and they are trying to tell me that the magnussun act only applies to new cars. Is this true do i still have a chance. Also after looking through my warranty i found that they dont cover the exhaust system anyway so why would it matter if i mod it.

It applies to Warrentys.. thats it. If its new, Used what ever, if you have a Warrenty (NOT A SERVICE CONTRACT) then it applies.
Read your contract, there is a section on "whats not covered" read it, understand it. Notice that it says just about the exact same thing as the Magnuson act (assuming you've read that).
BUt like I said, that act only applies to Warrentys (which are provided by the Factory Not the dealership, which sells Extended Service Contracts)

So yes, You have an Extended Service Contract, in which the Magnuson act doesnt apply.
as far as going to arbitration... How much did it cost to repair the car? as thats the amount that you'll be able to get from Honda if you win. But it will cost you $100-$200 to fight them through arbitration.

If you go through arbitration, what you are going to be asked is the Value of the claim. That Value will then determin how much AAA is going to charge to Arbitrate that claim. Mine was $1900 and the total cost of arbitration was around $250 (honda covers half of that cost).
once the claim is posted and paid for, AAA will asign an arbitrator to the case. At that point you will send in your inital Argument, This is VERY important, Treat this exactly as if you were in court. NEVER admit any guilt in any thing. Simply state the facts, and disclose what you had "modified" on the car. Honda Care is going to claim that your modifications alter the performance of the car, and they are going to try to say you are a street racer or what not. Basically any thing to get the arbitrator to side with them. Dont Bite in to what they say, Reply to ONLY the Technical things that you can prove. NEVER mention any thing aobut how or where you drive and Do not respond to any thing about Racing. Stick to What failed and how Noting on the car could have Caused or Contributed to that failure.

regardless of where the warranty came from it does state directly in the warranty the part has to contribute to or cause the problem. the parts you had on did not contribute to the failure of the motor. FIGHT IT! make them eat their words and their own warranty. you are entitled to it as you purchased the warranty with the car.

new motor - 4650.92
labor for 1 out 1 in - 14 hrs - 1200.00
Wow am i glad i did that myself i did it 2 hours faster and 5350.00 cheaper

LOL!! That's more than an 8 cylinder mercedes engine!!
Go Honda! They doubled the standard labor rates as well.
Wait, have you already swapped in your new engine? If so, that might create a whole new barrel of problems as you would have essentially voided the warranty on the entire thing, even if you do win at arbitration (for example) wouldn't you have already effectively voided your entire warranty.
Insofar as all these costs are concerned, if your new engine is ~$500 total and arbitration will cost you $250 plus all the time and effort you have to put into it, just swallow the costs, as it probably won't be worth the hassle. Especially if, as stated above, the factory warranty isn't applicable anymore and you only have an extended service contract.
