Re: First major accident...
just gotta deal with it, snow driving sucks and they dont let you blame the weather. esp if he was stopped and you were moving.
Re: First major accident...

Re: First major accident...
get this for shitty ohio laws...
I was parallel parking earlier this year and messed up on my first attempt....my back tire was resting on the curb and I was sticking out about 18 inches. I saw traffic coming, so I didn't want to pull out, so I just sat there and this guy in this Dodge Laser hits my front bumper. Cops come and say I am at fault because, no matter what, when you are parking, you no longer have the right of way. The only way it would have been his fault is if I had screwed up the parking royally and went front first. If he would have hit the back of my car, it would have been his fault.
Cop decides not to right me a ticket because he said it was a shitty law, but I got stuck with the insurance tab for the other guys car. State Farm dropped me too after that. I was pissed to hell.
But yeah, you hit him unfortunately and the way the law is written is that no matter what you were doing or what happened, its your fault as you should have allowed yourself enough clear distance to stop. It's the 'slam-on-the-brakes-in-the-middle-of-the-road-for-no-reason" argument. You can randomly slam on your brakes on the middle of a crowded freeway and if somebody hits you, you guessed it, its their fault. All you have to say is 'I saw a squirrel' and the cops cannot find you at fault.
