tranny

my car 03 civic lx sport went in in oct/05 for a complete tranny rebuild at 87000km, 1700.00 bucks was the warranty bill.. in jan.06 i started to here noises again in the tranny and now it wont go into first gear, unless i put it in another gear first. i called jonker honda in langley and they asked "whats the mileage"? well its 100008. "sorry no soup for you!!!" out of my kitchen!!! i couldnt believe it, brand new tranny and they wont warranty it, hell even from a wrecker i get 6 months!! so i called honda canada and they said to have honda pull the tranny diagnose and they will deside if its going to be covered. well my question is this ,.since the clutch will be right there should i just replace it with an aftermarket one? i looked at it at 87000km and it was perfect. no i mean perfect! also is it time for a new timing belt? and do you think they should charge me to put in the new clutch at this time as they are servicing the tranny anyway? anybody think that the syncros are shot? that my guess and man it better be covered or jim harrison is going to have a field day defending me against honda on this one, after i take them to court.
