friend got car towed, damaged

friend got car towed, damaged

alright so my friends car got towed
he has a dc5, its lowered on s techs and he has a front lip
well he picked up the car today and now his front bumper is cracked and his lip is cracked, they bondoed it up and spray painted it thinking he wouldnt notice
you can totally tell its bondo they didnt even sand it or anything you see huge slobs of it.

can he go after the company that towed his car and impounded it?

it was parked in front of his garage

im thinking regardless of if it wasnt supposed to be parked there or not they shouldn't be damaging the cars that they tow

Of coarse he can go after them. They damaged his car while performing their service, and then on top of it they did an unauthorized repair on his car. Did he sign a repair order giving them permission to repair his bumper? Of coarse not, they tried to cover their incompetance by doing a shoddy repair instead of notifiying the customer and paying for a reputable shop to do the repair.

Some towing outfits are full of real sleazeballs. If the quicky lube puts a dent in your door from opening it into the lift, they are gonna pay, this is no different.

Yes you can make them pay for it, but be prepared to show proof the car wasn't damaged before hand, When i had my blazer slammed on 20's I was at college and they were doing maintence to the road behind my door, so they towed every car off the side of the road to the parking lot without saying anything to anyone, well this was at 8 am and i was still asleep until i heard my alarm go off 4 times, the guy had somehow crack my front bumper when he was moving it, well I had just taking pictures the day before of my car and luckily i got the stuff replaced. He was like, I think that was already like that, i've never had a problem like this before. People need to be more careful, don't trust anyone!

You may have had a chance if you were arrested, but even then
Usually even when you hire someone to tow your car it is at your expense that is why you gotta get a flatbed type.

thats bs, even if u were parked illegaly, if they damaged ur car they have to fix it for u the way it was. U should have checked when getting the car though, now itz gonna be tough, but give it ur best shot. GOOD LUCK

Actually, that's incorrect. Any damage done to your vehicle by the towing company during the tow is the responsibility of the towing company. It doesn't matter if you were illegally parked.

It is "correct" though cause most tow companies will tell you it was like that when we got it and you have no way of proving they did it OR they will tell you to F off.

You can still file a civil suit or check if it's covered by your insurance company. Either way, the point is that it does not matter if you are illegally parked, towing companies are still liable for damage they inflict on your car. Whether or not you get your money is a different question.

there are pieces of his bumper all over the ground where the car was parked

I strongly suggest you call the towing company and let them know what's going on. Inform them that you have pictures and that there was debris on the road where your car was parked. They should have a record of the name of the employee who towed your truck. You never know, they might be cool about it and cover the repair costs. If not, take it to civil court.

it wasnt even illegally parked, wtf.. so if you parked in front of your own garage in ca, it'll get towed, not even a ticket.

in nyc, if its your driveway, it wont get towed, the most that'll happen is if a cop is bored, he'll give u a ticket but u can get it canceled after u show proof of residence.

i def. let the tow company know about it... if not, you'll always know where they're located..

I'd definately call up the tow company and talk with them about it before taking them to court but I also agree that they damaged it so they should pay for it. Good Luck and keep us updated

My best friends uncle tows around where I am...they only run flat beds, because theres quite a few lowered cars with lips and the like, and they kept breaking off, and they (towers) had to pay for it every time.... With the flatbeds they dont have as much trouble with it

Best of luck. If the car was impounded a lot of lots will have a waiver that states not responsible for vehicle. Just curious... Why exactly was it towed in the first place?
