Photo Radar ticket

My mom got a ticket in the mail today for a red light violation, but it happened when she loaned her car to my uncle. Is she still responsible because it's her car? Or could she show the picture to the judge and hopefully they'll dismiss it because it's not her? Thanks.

Nope. won't be dismissed but they may change the name on the ticket to reflect your uncle. It's a bit of a stretch since they are going based off the liscence plates. By any chance does the pic clearly show that it is your uncle and not your mom driving? If it does then they may change it, but if not then it is your mom's word against theirs and with photo proof they win.

interesting...but what if the photo clearly shows that it isn't my mom and she tells them that it's a stranger, then would they still demand the name of the driver?

I would take the photo to court and show them and ask what they say, or call the court and ask.

To me, the hole idea of this photo **** is stupid. So many people get tickets when they werent even driving, or say they were never speeding, or never ran a red light, etc...

Why do we have to have cameras doing what cops should be doing? I dont get it. We are paying all these taxes for extra cops, its kinda like they are starting to get lazy and this is the way for them to still make money.

It's still her car. Think of it this way, if the car was involved in a crime say murder, they would look into your mom as being involved because it is her car. She would need to prove that it was not her or taken without her consent to prove otherwise. As of right now, it was borrowed by your uncle with permission so there is the liability factor. You could always say it was taken without permission but then that brings up theft, purjury(sp) and several other little things. In the end it'd just come out more benificial to admit guilt or to have your uncle do it.

if your mom said its a stranger, then they would ask why would a stranger be driving your mom's car?
then you gonna tell them someone stole the car then ran the red light and returned it afterwards?

i feel you on this one 100%. very debatable and majority of people will also agree. most likely, the only ones who would disagree with your argument are officers themselves lol. its a unfair system if you ask me.



i think in california, a buddy of mine told me the drivers face must be clearly shown, the license plate must be shown in the photo as well. if neither of those 2 are in the photo, then it may be dismissed or not enough proof for fines. good thing for window tints eh? but as for your mothers situation, it varies. when the notice comes in the mail, have her write a letter to the court or appear in court saying she was not driving the vehicle at the time. cause i dont see why she should be punished for someone elses actions. yes, it is debateable and she is somewhat liable for the uncle, but you gotta take that to the judge.

try calling your courthouse and see waht they can do or say.

i could give you an example that happens everyday: you leave your car at the shop for service and repair, and the mechanic or someone at the shop you don't know or never met takes the car out for a test drive....

fight it....I've been caught twice and told them that I wasn't driving the car. they asked me who was driving I told them it could have been anyone of my 4 family members.
