hit and run-parked car
Last october a guy was driving drunk in my apartment complex and hit my civic where it was parked legally in my spot. The guy then backed up and drove his truck about 30 feet away and parked it, went into his apartment and went to bed. I woke up in the morning to see my car in pieces, the trunk was up near the roof, the bumper was hanging twisted on the ground, and the rear quarter panel was smashed as weel as the taillights. I looked around the parking lot and saw his truck with my paint on it and confronted him. He said he had been drinking the night before and didnt remember hitting my car. I called the cops. Turns out the guy had a suspended license for dui's and had to have a breathalizer installed on the ignition before he could legally drive, he had no insurance, it was a hit and run. The police wrote up a report but said that they couldnt charge him with anything because a apartment parking lot is a "private way". So 2500 dollars later my car is fixed thanks to full coverage and im suing him for damages, which he agreed to pay. But shortly after his first payment to me was due, he moves out and shuts off his cell phone. So now what do i do. The moral dilemma is that this guy will most likely commit another dui infraction and i have no means or way to stop it. My original intent was to get a judgement against him, put a lean on his property and take his truck so he cant drive, but now hes disappeared and im trying to think of ways to track him down. Any ideas?

Jeeze man. YOu need to report this to someone right away before this guy can get out of town. I would assume that the cops would have some method of tracking him down. How large of a town do you live in? If you live in a smaller town you should just cruise by all of the cheap hotels, and apartments looking for his truck.
you have his full name and birthday ect right? you need to call the cops tell them what happend. even if it happend in a parking lot it it still damage so why cant they wright up a police report? you need to sue him it will be an oppen and shut case.

yeah track him down asap..before he goes and gets treated for his "sickness". Some people will file for a illness like his drinking problem and get out of everything..so asap..

i already sued him, the cops already did a accident report, but said the could not do anything because it happened in a private way, i called and talked to the lt. and cheif of police, they all said they could not do anything. I live in a city of about 80,000.
so did you win when you sued him? cant he be arrested for not paying or something? thats your property right? so couldent they do something for damage to property seeing as how its always yours. no matter where its parked? the place where i park my car at school i belive is privet school parking but they did a police report when my car was damaged

yeah i sued him, and i won, but the thing is nobody enforces the other party to pay, i would have to send it to collections and that probably wouldnt even get him to pay. some people just skip out of their debts and dont pay. thats why im trying to track him down so i can get a address where hes at now, so i can get a lean on his property and take his stuff. i just dont know where to look to track him down.
Completely civil now, your local police are correct as far as being limited on what they can do whereas the accident occured on private property. You will have to go through claims court again to attempt to get all of the moeny you are owed. The police will most likely not give you his information to track him down.
