OH well, got a ticket
Well that sucked, but i guess it worked out for the best. So anyways, Im driving home last night from texas heading to cali, and im ohhh about 30 mile from Indio in BFE, and i decided to go around this truck that was moving kind of slow. So i dropped it down a gear and hit the gas and i was going up hill. Before i knew it, i hit the speed limiter (110mph) and was around him, so i started slowing down. Next thing i know im going under an over pass and i look too the top and see some headlights instantly come on. *Got to love them boys'* Yup its the beloved 5...O.... i didnt even try, before he could turn his lights on i just pulled over. I mean there really no where i could have gone to, to even try to say it wasnt me. *like i said i was in BFE* so i rolled the window down threw the keys out the car, and put my hand out the window. The officer comes up, and says "Well looks like you know what you were doing." I was like yah, i got a little trigger happy with the peddle and was passing a truck. "Well i clocked you going 99, just so you know the speed limit is 70... Licence,insurance and redgistration" I knew i wasnt getting out this one, here i was expecting to be arrested, car towed, impounded and all that mumbo jumbo. He comes back hand me my keys, says "I know you on leave and heading home so i wrote it for 10 over, so you can keep your licence and car." I was like well thats great! Works for me. No biggy... I called my brother up *whos a lawyer* and was asking him what i could do. So i got 2 choices which i can give a shot. Ask for refered Judification, *bassically means i couldnt get a ticked for 90 days, and if i dont ticket goes away and doesnt go on my record* or 2 Just do the Drives what ever corse, and get it taken off my record. So its no really biggie. I mean its better that i got 80 in a 70 vs 99 in a 70. you know?
So question other ways to get out of a ticket, im wondering if they are true......
1) How often does a police mans radar gun have to be calibrated? and is it true that if its not calibrated with in this time can the ticket can be trown out?
2) How often do the roads have to be surveyed? and is it true that if its not surveyed with in this time can the ticket can be trown out?
3) Doesnt a police man have to sit some where, 300ft in front of you, where you can see him for him to legaly write you a ticket.... Ie he was sitting on a bridge, where no one could see him, at night .. couldnt this be considered a "Speed trap?" And if i remember right, speed traps were banned in the state of californina *if not all states* in the 90's?

I read this and thought about how long it takes my car to reach that speed and though... what the hell is this guy talking about, it takes 5 minutes to get going that fast.. Then I read the profile.. K20A.. ahh I see.
I guess thats one problem with having a somewhat fast car. Oppsies involving the law are much more likely. Atleast it wasn't too bad on ya.. could have been worse.

With the new radar systems in cars, it is becomming more and more usefull to maintain accurate readings. Before an officer goes out on patrol, he is required to do a few things. If his unit is equipped with radar he is required to boot the system up and fire it at a set of forks usually found in the parking lot where the squad cars are held. He also has to write down what time he tested the equipment. As a rule of thumb, if you ever get pulled over, you DO have the right to ask him what type of radar he was using and if he has his calibration sheet on him. If not, you can fight the ticket in court.
With the other two questions:

thats gotta be a fun class, yo imma side track a lil bit i hope you guys dn't mind....
civicexboy, by what point does an officer have to read you your rights? in other words, if an officer forgets to read you your rights, when should you tell them (or the correct authorities) so you can be let go? i hope i worded that well enough.
A traffic stop does not mean an officer has to read you your rights. If you are being detained by the officer however, he is required to read you your rights. If not, you can use the audio taping of the detaining to get out of the citation or what not...Does that sort of help explain?

Well the point of detaining is usually for the best..
If he doesn't read you your rights and you are intoxicated,dont you think it would be a better idea to become arrested???? After the arrest however when you get to night court you are allowed to make statements and this is the time when you state that your rights were not read to you.

If it's in CA, there's an obscure law that requires the road to have been surveyed in like 5-8 years to make sure that the speed limit is reflective of how people generally drive on that road. however, my professor told me if you tried to pull that sh*t out in court, the judge would probably be infuriated
