Got hit by a Drunk driver.

Question Got hit by a Drunk driver.

Hey hows it going. Ok well yesterday I was updated on my acciddent and the lady that hit me was drunk and arrested for DUI. So what can I do about this? I want to get some money but I didn't think that you could by simply saying that she was drunk. I don't want to make her life a living hell but I want some money because I could have been killed. Any suggestions. Also if you don't know about the acciddent, check out my post about the acciddent.

just find a lawyer, but alot of them won't help unless you have some serious injury.

If she has insurance, then she won't be the one paying you, they will be. I say that if you aren't injured, then don't make a claim. Those false claims is one of the reasons that insurance is so high in my area. Sometimes, insurace companies offer you money if you sign a form saying that you aren't hurt. If they make you an offer like this, then you should take it. I was offered $400 after I was run into.

Big Rob is right. Talk to HER Insurance Co. They are the ones that should be responceable. (I know she is the one ultimatly responceable) But she'll have plenty to deal with. Sometimes Insurance Co's will offer an out of the box settlement, for situatios like this. They are basicly trying to cover their ****. It's a standard form that states you are ok, and not going to sue in the future for some "un-known problem caused by the accident", in turn for a settlement. I hope all goes well.

Ultimatley you will end up in civil court if you are trying to seek compensation for the accident, Fortunatly you have the arguement that she was drunk which led to the crash. Make sure you obtain copy of police reports or as much as they will give you when you bring to court. Who knows she may plead don to alessor charge and it might make it more difficult for you to get the money. Good luck.

That's pretty jacked up. I don't think you'd feel too hot if somebody did that to you. The word is forgive.

DAMN! You too? What is wrong with people? yeah I got creamed by a drunk driver on Friday morning! Except this guy got arrested for DWI not DUI! my car was more than likely totalled plus my neck was sore afterwards but it's better now! Good luck man! make sure you get every cent out of that lady!

Big Boy is right, unless you were hurt you CANNOT sue her, there was no tort against you, except against property. That is just like any other accident, the DUI is just proof that it was her fault, I do not think you can get any xtra money unless the insurance kina pays you off, like big boy was saying. You could however wear a neckbrace and take every cent shes worth because the neck pain keeps you from working and enjoying your life, that would be a sueable situation.
Do not worry about getting anything more than money from her insurance for the car damage, why would you what else has she done to you?Her crime of drinking and driving is a crime against society, and she will be punished in a criminal trial. Her only tort against a private citizen is wrecking your car.

no ****. I would love to have money if someone hit me drunk, but only if I was injured. If I wasnt injured, then I would forget it, and make the ladies insurance either pay for a new car or get the old one fixed like brand new. This is why insurance is so high. People trying to make false claims and people actually doing it. A guy at my work was involved in an accident and he was fine, but basically told there insurance company he needed therapy. What he ended up doing was 3 times a week he would miss 5 hours of work to go to therpay. This way he would be paid for the time he missed at work, but he told them he was making $12 an hour, when he only made $8 an hour. I thought it was fuked up.
