speeding ticket question..

i got pulled over today ina speed trap 50 in 30.. and then i told cop theirs not even a sign.. i literally didnt know speed limit.. he gave me 39 ina 30...if i brought it to court is that a viable thing.. or they gonna say.. you "should" know..

I had a question about this a long time ago and was told the following by somebody who found himself in the same situation and had to pay the ticket:

If there's not a posted speed limit, or if the last posted speed limit was 50+ mph, then you have good reason to contest the ticket. But make double sure there is no sign before you do contest it--sometimes the sign was a mile or two back and you just didn't see it. Also, make sure you know the exact location of the last speed limit sign and it's posted speed for the stretch of road you were ticketed on. If the last sign was for 30 mph and it was posted 10 miles back, and you never passed it because you got on the street at some point this side of the sign, the posted speed is still 30 mph and you won't get out of the ticket.

A speed trap is where the speed limit changes in a matter of a few hundred feet from 45 to 25 or something like that...

if you have a digital camera...go back to where you violated the posted speed and take pictures, then show them to the judge...

also, i believe there has to be a posted speed limit every X feet. if the last speed limit sign was 1-2 miles back, i think you have a way out. check the internet or your local library for your state laws and regulations. and yes, i would take pictures right away before they put a sign up...good luck.

don't pay it and get points, at least plea it down to a "driving in an unsafe manner" no point ticket.

This is just my opinion...

a) If he lowered it from 50 to 39 for you, I think thats a pretty sweet deal. Only 9mph over the limit is a LOT better than 20 over and IMHO you got a really decent cop, I know that NO cops where I live would ever do that. Ive gotten 2 speeding tickets both for 16 over and no help from the cops at all. I'd say you got lucky.

b) Dont just assume you will take points. When was the last time you got a ticket? If its been 18+ months since your last ticket, you can go to traffic school and you wont take any points and your insurance wont find out.

im not gon get points i took the class +80.50 fine and its clean slate...

here in FL its 12 months or calendar year.. so im good.. i got the test aced..taken it so many time
