I would imagine you would get a DUI combined with whatever penalty you would face for underage drinking/drunkeness.....and loss of license I would bet.
who knows....wouldn't want to be him though.

i can only speak for my state however the penalties usually aren't to different. most of the time it is an automatic license suspension, even before your court date. as far the ajudication process, it all depends on the jusge and state laws. some states have minumum sentencing requirments for OUI, some are more lenient. one kid i know lost his license for a year. i am almost positive that there will be some sort of suspension involved.

1 time back in like highschool, me and 3 other friends (all senior)...we drank, then we all hopped into my car and started driving to meet other people.
we all underage, drinking, driving (i was the driver, a lil buzz)...and was still passing alcohol around in the car while driving.
that was the most stupid thing i have ever done in my entire life!! never again!!!

In addition to the jail time, the bail, the license suspension, the fines, and the community service, I think you have to pay thousands of dollars extra each year to renew your license or registration.
About Two weeks ago I was following all the cars to the races (saturday night) and I got pulled over and he said I was the lider which I wasn't but anyway I blew 0.4% I don't know about other states but here in NC is 0.8% for them to say u are impared so they let me go.....but I have court on the 2nd of next month!!!!
www.megalaw.com/top/drunkdriving.php This might help your friend out, I am at the tail end of a 6 month suspension and about 3000.00 in legal fees fines and mandatory classes. I got off cheap compared to a few other drunks I know. Take it from me its not worth it, my time was up I'm older and now wiser. Best advice I could give is to get a good lawyer and know the laws before you go to court, use any favors you have out there for legal help because its not cheap. I got off with a 6 month suspension and negligent operation, Never take the first deal unless you really ****ed up. But learn from this mistake and pay attention in the classes and counseling you will be forced to go to. You don't want to go through this more than once. Good Luck
Yeah he's in a world of hurt. I know that out here in So Cal as well as other states that there is zero tolerance for drinking under 21, if you had 1 beer, weighed 250 Lbs, and had an eight course dinner, and sat around for a few hours after that beer, you're still hot. kind of sucks because regardless of you alcohol level you are guilty

I hope you meant you tested a .04 % because if you blew a .40 you would be close to being dead.
