Whos got right of way?
Maybe some of you can help me out here with some of my troubles.
I was driving home from work today, and got in an accident. It was the weirdest thing because I knew it was coming before it happened. Anyhow it went likt this.
There is a 2 lane highway. The traffic was light, but comming up on where the road turns into 1 lane traffic always backs up. So anyhow I am proceeding around 50 mph or so until I see the traffic slowing (not stopped, just slowing) soooo i slow down to about 35 - 40 mph. This lady in a huge SUV was traveling at my same speed. I was about a car length ahead of her maybe less. I was in the right lane and she was in the left. So as traffic slowed (me in the merging lane [Right]) i flipped on my blinker knowing she was there and began to merge. I noticed her not allowing me the space to come in so I just started to merge over anyways because I had to (if i didnt i woulda nailed the curb). I figured she would see me and let me in (if she didnt see me already). She then proceded at my same speed only now her front end of her SUV was at about my door and driver side window. She then noticed she was being pushed into on coming traffic so she turned into me naturally. Is she at fault or am I? Because I am merging does she have the right away. She is going to claim I was trying to pass her because she didnt see me. AS soon as she got out of her car she was screaming at me "IT SAYS NO PASSING" I can promise you guys I was not passing to get ahead of her in 35 mph traffic. She thought i was passing because she just never saw me and she assumed that I appeared there from behind her... is she at fault...??? Thanks doods..

Rep Power: 313 thats exactly how my first accident went down... cept replace "suv" with "speeding ambulance without the lights flashing".. i got a ticket for impropper passing.. the guy driving the ambulance got a whole bunch of tickets.. which totaly saved me cuz i took it to court and since he got tickets for doing a bunch of stuff wrong it was decided that i was passing propperly (even though i wasnt passing.. just merging)
just to keep yer insurance from going through the roof id try to fight it

Rep Power: 0 yeah.... thats what I pretty much figured. I swear though she just never saw me. She ****in just plowed me and I am at fault I was clearly ahead of her. A cop examined the damage and said that you can tell I wasnt passing her because the tire mark on my door proves that she and I were traveling at the same rate of speed
she just didnt see me or didnt wnat to let me in. HOW STUBORN DO YOU HAVE TO BE TO NOT LET SOME ONE IN TO THAT POINT.......

do you have her insurance info? did the cop give you a ticket because you were at fault? if you have her insurance info call them up and say, i need to file a claim because one of your clients hit my car.. if they have her story cause im sure they will.. tell them well its her fault. they will then come out and investigate your cars damages, and determine if it was your fault or hers. if they say it was yours, they call your insurance, tell them the problem you are having and have them fight with her insurance co. my mom had to do that when a guy did the same thing. he tried to say she was passing or some ****, but the damages proved it was his fault.
