You will be deemed to be not at fault in this accident. Obviously. So I cant see why your ins co wouldnt cover it. A suggestion might be to take a couple pictures of the damage now. you know, just in case theres any questions as to what in fact got damaged etc.

Hopefully you did the following:

When you are in an auto accident.
1) stop, get the vehicles out of traffic (unless if the guy hits and runs, you'd better write down his tag #)
2) call the cops
3) explain the situation to the cop
4) cop will provide you with a report along with all three vehicles information.
5) contact the insurance company of the person at fault and file a claim against them.
6) their insurance will schedule you to go to a shop so they can inspect the damages.
7) estimate is given to you
8) go and get it fixed, person at fault's insurance pays you (dont forget to make them pay for a rental car)

If the guy doesnt have insurance hopefully you have comprehensive coverage or uninsured motorist coverage, the only down side is you have to pay a deductible and your insurance rates could possibly go up.

Hopefully you followed those steps and filed a claim already, if not and that guy got away scot free without a cop writing up a report, you are screwed!

dude

ok, how if you the person who bumped you want to settle the situation "peacefully" by not contacting the insurance company?

what should you take from him/her?

do you think it's ok to do it that way?

I got a police report, follow all the right steps, but my question is, are his insurance company will cover aftermarket stuff, like my rear bomex body kit, neon tubes, and front projector lamp(after the accident the lights start flickering, angel eyes not working, and ****).

^ If it was all insured, then, yeah, but, if it wasn't, then start saving. I insure everything. Dont care if rates go up, only like 4 bucks.
