pulled over twice in 5 mins!
hey guys....i was hoping you could give me some advice for my friend. He was pulled over after being "paced" by a police car on friday night (prom night for a local high school, so police were out in full force). he said that he saw the car from a ways back (it was a marked car), and so he made sure he was going exactly the speed limit (45mph). the police car was weaving in and out of traffic behind him, then pulled him over and said that she had paced him at 65mph. he said he was sure he was going exactly 45 though...
then within the next 5 mins, another patrol car pulled him over, walked up to his car, shined his flashlight in the cars windows and looked around for almost a full minute he said, before asking for his liscense, and going back to their patrol car for a bit. then they came back and asked him if he had been drinking or smoking at all. he said no, the cop looked around inside the car again w/ the flashlight (never asked to actually search the car, but just looked through the windows w/ his light), and then said that he was writing him a ticket for an illegal exhaust system, and told him that if he didn't take it off and put the stock one back on, that he would have to pay heavy fines, etc.
i told him that he should go to court for both of them, and maybe he would get lucky and they wouldn't show (slim chance, but it happens). secondly, is there any legality issues of the second officer pulling him over for basically no reason, then just writing him a ticket for whatever he felt like? also, how could prove it in court? any ideas are GREATLY appreciated. thanks guys!!

cops are full of ****, fight em both. probably some young pigs trying to look important. i had two cops after me lastnight, 50 in a 35, and 40 in a 35.. got away from both. slid in behind a closed down gas station,few minutes later, i saw the sirens fly past, haaaaa.
thanks....i guess....lol....but its to late to try that now...plus w/ luck like this, i'm sure they woulda found him and hauled him away for attempted evasion or whatever. either way.....any other thoughts guys? common, there must be SOMETHING he can do......
he can try and fight the speeding ticket. as far as the 2nd cop, legally they can look in your windows (as something might be in plain and open sight), but it looks like he used the exhaust as an excuse becuase he didn't find what he really wanted.
i'm sure the 2nd ticket can get dropped if his exhaust is in accordance with the law. you'd have to find out what he is actually in violation of with his exhaust.

actually an officer i know told me they can't shine their flashlight in the backseat of the car without consent to search, or probable cause to search

Damn you in VA? tough **** there... it depends on your State Law I guess coz some state allows mods as long as it is CARB legal and and as long as it is below DcB allowed for the noise and what not I'm not too familiar though... but hehehehe I'll try the old closed down gas station trick sometime
Having a modified exhaust is a just cause to pull him over. maybe the officer pulled him over for that reason. And, Idont know what state the other officer is from, but you are able to shine the light in the cabin. and what ever is in sight. but we cant go inside the car and search.
as for the 1st officer.. I dont know about that one. 45 and 65 is a big differance.. and for the weaving, its hard to drive, look at the laptop, and type in someones plate at the same time. so a little weave is common.
Your friend could fight the speeding ticket, but not the exhuast if he is in violation of your state law.

one of my friends, from california was in this week, and we were going over in ohio, and the stupid cop gave her a ticket for "being too close to the yellow line" rofl. what a joke! dumbest thing ever!!!! too close to the yellow line? i mean, aren't they there to stay between? i didn't know there was a "closeness to the yellow line" law. lol. the judge laughed and dropped it.. morons.

theres nothing wrong with having a exhaust, the difference is if its certified, but if its legal but you dont have papers saying its legal then he can give you a ticket, and if its illegal then of course its illegal. The cop that pulled my friend over in my car said that he didn't want to see my papers saying my exhaust is certified by state referee's and he said to prove it to the courts.

and you are also an idiot. i hope you get caught. i doubt they were going after you with sirens for 15 over. you have to be a total sh!thead for a cop to try and get you for 5 over as well. trust me, we have better things to do then supposedly "harass" kids with their cars. i can see where this thread is going.....

whoa...take it easy! I was not replying to the thread to poke at anyone, but instead state the truth. Up here, the police have enrolled a program called "pacer". Police and Community Educating Racers". It is used to educate the public on the do's and dont's of car modifications. I was simply pointing out the fact that the officer could be checking out the car to see if there was anything in the car that shouldn't be.
As well, you can't deny that the majority of modded cars are for street racing purposes. Most of us don't drive to the track when we want to drive fast.
I come from a family of law enforcement and mean no disrespect.

heres some legal advice guys, trust me this is how it works.
1st the cop has the right to flash the light anywhere in the car aslong as he does not look under seats or do anything of that nature. he can look around the car without poking or proding. he does not have to ask you to do this.
2nd thing, pacing is very sketchy. you can go to court for this and probably win. the thing about pacing is the cop cn only make an "educated guess" or "Inference" and the only way it will stand in court is if the cop was like 6 feet behind him. if he is not close to the car it is not accurate.
3rd. exhausts tickets are real and they will satnd 95% of the time. pay that and just deal with it.
4th. the cop will not show up to court. in Quebec, im not sure about the U.S. we have court appointed stand ins for cops so someone will always be there.

That's good to know! Last year I was ticketted (in Ontario) for an Illegal "cannon style" exhaust and low tire tread.
I took them both to court with photos of the tread on my tires as proof they were fine, and the officer didn't show. Both cases were thrown out!
$500 bucks more spending money for the vic!
