got a speeding ticket but ....

Im in idaho, got a speeding ticket the other day 36 in a 25. Now as i recall im supposed to sign the ticket. Well the officer didnt have me sign it and gave me the ticket and off i went. So my question is should i fight it? And if so would it be in my benifit to bring up that he didnt have me sign it? Knowing how some judges are they my get more PO'd if i did bring up the no signature.. What ya think ?

dont fight it since its your first ticket. you'll prolly just get traffic school and get it dropped from your record. but i dont see that it would hurt you to mention that this happened to the judge in court.

technically if he didnt have you sign it its almost like it never happened. usually signing it means you are achknowledging receipt of the summons. but that differs from state to state.

Consult a lawyer, it should be free. I would always fight a ticket, they don't get mad at for your trying to fight it, it's your right to do that...

When a cop pulls you over, you are technically under arrest. In order for him to let you go, you have to sign your summons which is your promise to appear in court. If he tells you to sign it and you refuse, he takes you to jail. Since you didn't sign, you never promised to appear. If you're ballsy and it's worth the risk to you, just don't show up. -Should- be legally defensible in court should they proceed with a failure to appear.
