What to do....

So I got a speeding ticket by radar for going a 83 in a 55 also for tint on driver/passenger windows.
Ticket came out to $431.

Thing is in the vehicle code book under the speeding code it states that there must be visible sign saying the speedlimit. On that whole road there wasnt any so I kinda have something against it. Well except I was going 82 so even if it was a 65 I still would have gotten a ticket... Is it possible to still win because they also didnt follow the law? Is it likely for them to reduce the fine?

The tint.. Its not a fix-it ticket so i think it came out to like $150. Is it possible to tell them to make it into a fix-it ticket or is there no luck there? The code he got me for is very general and just says there cant be any objects blocking the window. It doesnt really particularly say tint.

Main concern is if I fight it and lose, do i have to pay more than the $431 or is that the max I have to pay?

ouch a 431 buck ticket, i hope u get out of it someway, but im not the one to tell you how

ya sucks cause i honestly didnt know the speed limit because it was 1 1/2 away from my house in the middle of no where with hardly any cars. You swear anyone drives speed limit out there...
and the tint i always thought it was a fix-it but i guess not...
Worst of all he was those cops with something stuck up their a.ss. He had a badd attitude.. its like wtf.. just give me my ticket, your comments arent necessary. even asked me to step outside the car for some reason...

In AZ if there is no posted speed limit then the driver will drive 65mph until he sees a posted speed limit sign and then he can adjust his speed appropriately

(b) Notwithstanding any other provision of law, no person may
drive a vehicle upon a two-lane, undivided highway at a speed greater
than 55 miles per hour unless that highway, or portion thereof, has
been posted for a higher speed by the Department of Transportation or
appropriate local agency upon the basis of an engineering and
traffic survey. For purposes of this subdivision, the following
apply:
(1) A two-lane, undivided highway is a highway with not more than
one through lane of travel in each direction.
(2) Passing lanes may not be considered when determining the
number of through lanes.
It was a 2 lane highway but how am I supposed to know its a 55. I live in the city where there arent many highways.

Right under it section C says:
(c) It is the intent of the Legislature that there be reasonable
signing on affected two-lane, undivided highways described in
subdivision (b) in continuing the 55 miles-per-hour speed limit,
including placing signs at county boundaries to the extent possible,
and at other appropriate locations.
The highway is fairly small about 5-10 miles and there arent any signs ANYWHERE. I believe its also a county line.
If I was clocked at 70mph I know I can win but I wasnt so I atleast want to try and get it reduced since its so high.


Here's the tint one...
26708A1
26708. (a) (1) No person shall drive any motor vehicle with any
object or material placed, displayed, installed, affixed, or applied
upon the windshield or side or rear windows.
To me thats very vague. It could even mean that the tint on my rear windows is illegal which isnt. Is there someway I can fight this?

if you try to fight it...they will probably say that regardless of there not being a posted sign, you are to be driving at a reasonable and prudent speed (in which 83mph is not)

Thats the same thing as in AZ...If you dont know what the speed limit is then you're expected to go 55 until you see a posted sign

And for the tint, ask the judge if you can get it fixed and bring the receipt to court as proof to have the fine knocked down or something

But then if you read C it clearly states there should be signs posted up. I live in the city and there really arent any highways within a 50mile radius. There are highways in the canyons but those all have signs and are all under 55mph. Blah maybe i'll just pay for it

per california vehicle code a "highway" is really anything you can basically drive on... a 2 lane paved country road is a highway

Maybe you would have a slim slim chance if you were driving 65mph or little over, and you thought it was a 65mph zone. But you were going 82mph. That's pretty fast. Just get a lawyer and hopefully the money you pay now will save you in the long run in insurance.

In PA they would have taken your license right in front of you for at least 90 days (I think). So it could be worse. Anything 25mph over the limit results in automatic suspension. Good luck!!!
