Ok I need some homework help I missed these 4 questions (out of 40) and there seems to be a lot of smart people here:
1.Who decides whether or not evidence is admitted during the course of a trial? What standard is to be applied to appellate review of evidentiary rulings at the trial court leve? (Is this the Magistrate?)
2. Why might a court exclude evidence regarding one party's drinking during the course of a trial of an automobile accident case? What social policy is being advanced by excluding such evidence?
3.As a general rule, evidence of prior and subsequent accidents have been excluded by courts in actions relating to cases involving negligent infliction of personal injuries. Are there exception to this "general" rule? Is so, what might these exceptions be?
4.Can evidence of prior criminal behavior ever be admitted (for or against) a party in a civil trial? What about a criminal trial?

they may vior dire (trial within a trial) to see if evidence, or a statement utterence or otherwise may be admisable. the judge ultimatly makes the ruling as to admisability.
as for the rest, sorry, cant be of great help. sounds like youre dealing with a lot of case law which im sure differs from Canadian law.
