As many of you know, the bacon gave me a ticket for exhaust... among other things...
State law states that muffler systems that emit a sound lower than 95db are permitted on the streets... Guess what mine clocks in at?

So I had the guy do it WITH the silencer, registered in at 85 db. Do you guys think I should present this certificate to t he judge although the citation was with the silencer off (w/ pics taken)... its TECHNICALLY the same muffler, so what should I do? Should I mention to the judge that this cert. is with the silencer ON? <<Confused>>

Rep Power: 0 i don't know if thats gonna work but my friend has a "street legal" Greddy exhaust with carb and everything. He showed the judge and the judge said "so"...and still he had to pay the fine...

I got away on the sound part, but modifying my exhaust system in maryland is illegal..

Rep Power: 0 My bf got the same ticket I called chp and there is no CERTIFIED SOUND TESTING place in the state of cali so we decided to fight it, well he did trial by declration (I wrote the declaration). We went down to chp to ask them about it to make sure. They said they are not suppose to sign it off but he listened to it (ie my bf has a Apexi N1 Turbo we had the silencer on) and signed it off but it didnt matter cuz he had already requested a trial by declration. well here is a copy of the delclaration and the link where i got the chp memo CHP MEMO , well they dismissed the citation just the $10 fee.
I, NAME, declare as follows:
On February 6, 2003 at 6:15 p.m. I was pulled over by a California Highway Patrol Officer on Sweetwater Road in Spring Valley. I was given ticket number 61258RV for violations 27151A VC and 24003 VC.
27151A VC - At the time I got the citation I was told by the officer that it is illegal to change your muffler and it is not a correctable violation. I then proceeded to call various CHP offices about having the sound level of my muffler checked. CHP told me to call a muffler shop, muffler shop told me to call the Bureau of Automotive Repair, the Bureau of Automotive Repair (CIS) informed me that there was no facility in the state of California to test the sound levels for mufflers but there might be one being built. The State Referee does not deal with mufflers. I went to court on June 2, 2003, to ask the Judge what I should do. The Judge recommended Trial. After court on June 2, 2003, I found on www.greddy.com (a manufacture of mufflers) a CHP Bulletin No. 98-100 (Exhibit A). On page 2 Q4 states that it is not illegal to put an aftermarket muffler tip on your car however it is prohibited to amplify or increase the noise emitted. Page 2 Q5 states that The prohibition against unusual noise refers to noises that are unusual for motor vehicles. Noise that may be unusual for a particular make or model of vehicle, but which is not necessarily unusual for other motor vehicles, should not be considered in violation, provided the noise is not excessive. On page 4 Q11 states What happened to the Muffler Certification and the Licensed Muffler Certification Station Programs? Funding for both programs was terminated in 1979. There are currently no Official Muffler Certification Stations, no listing of certified mufflers and no formal mechanism in place to conduct objective vehicle or exhaust noise testing. After finding this information I went down to a CHP station and had an officer listen to my exhaust. He then told me that it was not excessive and signed off my ticket (Exhibit B) on June 2, 2003. There is no place in California that is certified to test the sound levels of exhaust noise. Citations are giving on the basis of one officer’s opinion not by any actual evidence of the sound being over 95dba. Your Honor, based on the facts above I ask that you dismiss Citation 27151A.

Rep Power: 0 I got it tested at a place on Winnetka blvd, 1 block (or s0) past saticoy. The place is called California Muffler, ask for Joe Gee. $20 bucks flat rate for testing. They seem to do REALLY REALLY high quality work too based on the cars and pics and satisfied customers who I talked with while waiting.

Rep Power: 0 And AK, i have the Megan N1 style exhaust. Weird though.. as I have been doing a LOT of canyon runs lately, my engine has been getting REALLY hot, and so has my exhaust pipes.. they melted my bumper really bad and for some reason the exhaust shrank or something and is sitting WAY closer and WAY back (towards the engine) then it was before all this mountain driving.. maybe the piping shrank from the heat when it cooled down? The difference of where the muffler is NOW as opposed to where it was before is really obvious... and I never hit it.

Rep Power: 327 Yes indeed, those laws were changed in the early 90's if I'm not mistaken. I think it had to do something with the accordance of smog laws but Im sure Im prolly wrong about that.
