Warranty? Get an optima battery. IF, and I mean IF you have any other problems, just put the original battery in the car. No warranty issues.
Honda loves to blame your tint for a bad transmission, etc, etc, etc.
You really just have to know how to play the game.
I have an optima battery, and honestly, it was a great investment.

I did try turning it to the accesory position (3) before starting and it does seem to start everytime that way.

Two things -- The owners manual says that if it dosen't start is due to the immobilizer system, and to retry, true.... however....

COLD out <10-d-celcius -- never have a problem starting.

Happens ALWAYS in the summer for me once or twice a month. Think it could be a vapor lock of some sort. Various cars have this problem like older Toyota Supras. Fuel rails, return lines to gas tank, emmision vacuum lines fill up with hot gases after you turn the car off. You'll notice that even when you turn the key to ON position and wait for the fuel pump to stop, it still takes a while to start, usually starts after 5 seconds - never much longer than that - just enough time to purge the lines with fresh fuel. NOT MUCH you can do if this is the PROBLEM! Don't bring it to Honda, it will NEVER happen when they test it! never does.....

The problem is because of the emissions system. It cleans out the exhaust system before starting so it can sometimes crank for a couple seconds first.
