I was rear ended on my left rear corner. The cosmetic damage was repaired at a contracted dealer body shop covered completely by insurance since it wasnt my fault. Its been like 1 1/2 months since the work was done, and I notice now after a rainy week that I have a puddle of water in the bottom of my trunk and its origionating from the corner that was damaged in the accident.

Do I:

1. Go to my dealership?
2. Go to my bodyshop?

If they dont want anything to do with it do I:

3. Call my insurance company?
4. Sue the guy who hit me for damages?


I totaly dont know what to do here.

the work should be warrantied...go back to the body-shop

Body shop ... but also let your insurance company know that there are still problems with your car. They may have their own policy on how to deal with unsatisfactory repairs.

In california, if someone hits you, and you can get an estimate of your car from
a dealer of what your car is worth and what it would be worth if it had not been
in a wreck, you can sue for the difference

Boy I tell ya. I always said "If I get hit I hope its totaled". I'dd be willing to trade some bumps and bruises for a new car.
