Fuel gauge doenst work post accident and the insurance company says existing issue and unwilling to fix it .. have taken it against AFCA the regulatory body and now need to prove it ..

I'm guessing the FLS in the fuel tank was damaged. Only way to replace that would be to drop the tank (or potentially access it from under the back seat, but I'm not sure how it works on that generation).
No way to prove it legally beyond "he said, she said". It'll more than likely total your car at that point anyway if you factor in the labor to fix the cosmetic damage in addition to whatever the labor would be to drop the tank.
