Hey guys, I Need Help On 2 Tickets I Just Got!
i've looked all around this site and also yahoo but not finding much help when it comes to laws in canada...
well the problem is i just got these tickets this morning for
1. Failing To Stop/Disobey Stop Sign
i admit it was a rolling stop but i didnt completely ignore the sign.
any suggestions anynone?
2. "Improrer Muffler"
i currently have a magnaflow exhaust. does anyone know what is the legal descibel reading b4 a loud muffler can be considered "too loud"? is it even worth fighting or should i just pay it off?
any suggestions?

Muffler
75. (1) Every motor vehicle or motor assisted bicycle shall be equipped with a muffler in good working order and in constant operation to prevent excessive or unusual noise and excessive smoke, and no person shall use a muffler cut-out, straight exhaust, gutted muffler, hollywood muffler, by-pass or similar device upon a motor vehicle or motor assisted bicycle. R.S.O. 1990, c. H.8, s. 75 (1).
Unnecessary noise
(4) A person having the control or charge of a motor vehicle shall not sound any bell, horn or other signalling device so as to make an unreasonable noise, and a driver of any motor vehicle shall not permit any unreasonable amount of smoke to escape from the motor vehicle, nor shall the driver at any time cause the motor vehicle to make any unnecessary noise, but this subsection does not apply to a motor vehicle of a municipal fire department while proceeding to a fire or answering a fire alarm call. R.S.O. 1990, c. H.8, s. 75 (4).
I would argue that the magnaflow is in good working condition and is not making an unusal noise. Also point out that this brand of exhaust has a resonator.
As for making unnecessary noise you could say that causing your vehicle to accelerate is a normal activity of driving and is, in fact, quite necessary.

Rep Power: 0 What I don't get is how he got you on an improper muffler when you were slowing down to stop for the stop sign. I mean the muffler is only loud when you are accelerating. He must have just seen and and thought it was too loud.

Rep Power: 0 The improper muffler ticket you got had nothing to do with how loud your muffler is. Been through the same situation before and the officer said "if I can stick this stick into your muffler without it hitting a bend, then its improper" . He also told me that having my screen up is another ticket... . After that, he just decided to give me a ticket for "obstruct of plate".

Rep Power: 0 ok well after i got stop for the stop sign. he stood outside my car and was staring at my muffler for a good 5min.
then he told me to step on the gas and give it a lil gas. so i was like damn, so i tapped the gas to about 2000 rpm, then after hes finished writing the tickets he was like "you fail to stop at a stop sign n' ur mufflers loud ands its not stock. there has been alot of street racers, and not to say that U are one but ur car looks like a racer"

if the cop shows for court u cannot contest anything if you were rolling and did not stop completely.
2nd...any fireball canister style muffler will get a ticket...your muffler is suppose to be chambered and not straight through. I think the canister style is considered Hollywood style in the HTA. If you tell them that you just replaced the muffler they will probably drop the charge or suspend the fine.
oh and with the screen...the key is to tell them that it is GPS and not a DVD player

does it say anything else on the ticket about "improper muffler"??
does it sya too loud? or just improper muffler?
as for the failing to stop... stall the court date as much as possible and hope the officer doesnt show up...
till then, hope for the best.
