Tickets & Insurance - ATTN: NARC

Well here's the deal.

I'm a dumbass.

I got another speeding ticket, 40 over. 90km/h in a 50km/h zone. $295. (4 demerit points I believe).

I am pleading "Guilty with an Explanation". I did this last time and I got a ticket (exact same fine), and it got reduced to 25km/h over (from 40km/h over). When you choose this plead, you are given an appointment for like 6 months later.

Here's my questions:

1) Do all speeding tickets go to your insurance company? Do they always find out or do they only find out if they check your records for some reason?

2) Will the ticket only be processed after the final ticket is paid (i.e. after the court thing in about 6 months from now?)

3) How much would it cost a 20 year old with 2 tickets in the last 3 years (25km over and 40km over) for primary driver insurance? (roughly).

I'll keep you guys updated, because I'm probably parting out my car (parents will probably not let me drive anymore, and/or I won't get insured)



NARC - I got the ticket in Oakville, officer name Marini or something along those lines. I was wondering if you could help me out somehow? (i.e. if you know the officer, or if there was anything you could suggest or try and do for me). I am most likely not going to have a car anymore because I won't be able to afford insurance since I was an occassional driver when really I was primary driver and the insurance company knew that. THey said if I get in an accident or another ticket, I will have to be first driver and pay a **** load of money. ON top of that, my parents probably won't let me drive any of their cars as punishment. PLEASE help!!

Insurance will see the final ticket, because you are innocent until convicted, so whatever charges won't show up until you plead guilty or you lose your case.

Getting two speeding tickets will definitely get you raped for insurance. Speeding tickets like yours count as major offenses and an insurance company won't like a sub-25-year-old with two of those. If you even get into a slight bump with another car they will probably even cancel your policy, in which case you can go to high-risk insurance for about 5-10x the normal insurance cost for your car.

I would recommend getting someone to fight this second ticket for you.

PS: My insurance for the 01 Civic Si, as a primary driver, with an extremely minor accident (not my fault), at 25 last year, was $2900. If you have recorded speeding tickets I would guess $5000~6000 easy.

Yeah I called X Copper and just faxed them some information. They should call me back soon.

As for the insurance, X Copper says that it stays on record for 3 years but they can look back 5 years if they really want to.

well I was told by a few differnet insurance companies when searching for insurance (I had 2 speeding tickets also) and they said 2 speeding tickets as long as they are under 50km/h over the speed limit only count as minor offences and wont hurt your insurance. But im sure it depends on the company

heres an idea, dunno if ya wanna go this route, but its what my uncle does... keep rescheduling the court date
reason he did that was because by the time he goes in to fight it (and isnt going there to reschedule/send someone to reschedule) he would plead innocent or guilty with excuse, but since the ticket was from SO long ago, the cop either wouldnt show up, or didnt bring his notepad/booklet in which they jot down notes. so the cop can no longer day "well i wrote this at the scene of the incident" to the arbitrator/judge.

this worked for him often so maybe think abt doing it. as well, if you're innocent until proven guilty, im not sure if this will work, but keep delaying the court date until the 25KM over ticket has finished its 3 yrs lol

i dunno if that will work and all but it just occurred to me. maybe thats another loophole in the system, maybe they have an answer to it. i dunno but it is a good idea if it can be applied.

the ticket itself, will stay on your record for three years.

NEVER PLEAD GUILTY.. unless you have no other choice.

otherwise.. EXPECT your insurance rates to sky rocket

especially with the ticket(s) that you're pleading GUILTY to.

insurance companies will find out, if for some reason.. they want to check your record or when you're renewing.

speeding at that rate.. insurance companies may might as well consider you a careless driver... driving at such speeds in a 50km/h zone

pleading GUILTY with an Explanation is pleading GULTY no matter what...

just ask the prosecutor before the trial starts to drop it cause your a student and you need the money and blah blah blah...

been to court many times and havent lost any points (knock on wood)
but come in confident and know your **** .. also be prepares to fight a case... and ask q's like

Did you Calibrate the machine?

Are you certified to use the machine?? and such... sometimes it works...

I've gotten 2 tickets in the past year (both stupid left turn stuff) so I know your pain...

As mentioned above, DO NOT plead guilty...fight it for sure...at least you have a chance to get points/fine reduced and save yourself the huge insurance premium increase.

I found XCopper to be a bit on the pricey side, so I went to a smaller place (they were successful in both my cases). PM me if you want a number for the firm...and good luck!

kinda on the same topic, If you got a DUI and got your license suspended for a year but kept insurance on your vehicle like nothing happened would that stop it from sky rocketing or would the insurance company be notified? I know they could find out but alot of compnies dont check unless you switch compnaies.

Well boys and girls, what has my advice to you guys always been with respects to traffic tickets.....fight it.

It will deffinately affect your insurance if you plea out to it. in fact, even if it gets reduced to only 15 over (no points) it will still show on your drivers abstract and will most likely affect your insurace for a period no less than 3 years.

Do your self a favor and hire a lawyer. Its very difficult for a regular sho like you to beat a cop in a speeding charge. But a layer will know what questions to ask, and current case law with respects to speeding.

Sure the officer gave you a break and reduced it, but trust me on this, if you take it to trial you will not hurt the officers feelings. He's a big boy and he can take it.

Oh, and before I forget, stop speeding in my hometown ya crazy baztard!! ha ha.

Good luck. For the record, I work in Mississauga and do not know any officers in Halton Region.

Hey Narc, another question por favor. A friend of mine (not me, silly man, I drive nice and slow) got a ticket going ridiculously fast, like 60 over or some stupidity like that. The officer reduced it quite a bit, but the fine was still hefty. If he fought it and the officer showed up, would the cop have any record at all that he reduced the charge or fine? I know it really is up to the officer's discretion, but could he then show up and say "Yeah I hit him with a 150-dollar ticket. But the original was for 300 and I let him off the hook a bit, here's my half of the ticket with the notes scribbled on it"

Well I know Im not Narc, but from my experience, they have notebooks in which they often record this kind of valuable info in. Thats why i said to prolong the court date enough so its possible to catch the cop without the correct notebook because he will be using a different one by the time your court date comes around. read my previous post for more details on that Telly. Hope it helps, but hopefully Narc will come in and save the day with 100% info!

I've fought every ticket and I only had to pay the full amount once. What I do is write everything that happened that day while it's fresh in your mind. Than a few hours before go to trial read it over a few times so your not going back on your words and it'll make you look confident. Than the keyword say your a student. All this worked for me but I'm from a smaller town with a small town judge.

450 for xcoppers... what's the point.. they can drop the charges...??? but narc say no matter what it will still be in the record... might as weel plea guilty with explanation juss to reduce that way u have a chance to take no demerits and reduce fine... even though xcoppers win wouldn't it still show up as an offense in insurance??? correct me if im wrong pls.

Hey RW,

My ticket is $295. Here's the deal, XCOPPER's moddow is, "we win or it's free". What they mean by "it's" is, your ticket. So think of it this way, they pay for your ticket no matter what the charges end up being for it (could still be $295, could be $0). So, their service fee is $450 (might be for my case only, I'm not sure if it's flat fee for everyone or not), and they cover the fees of my ticket, whatever they end up being.

The ticket will be in my record IF I plead guilty, or lose in court and am still given a ticket. XCOPPER is going to try and get the ticket totally gone, 0 demerit points. They say, "we will get rid of your ticket, 0 demerit points, and if we don't, we will pay your ticket for you (but you still ahve to pay us the $450).

SOOOOo......... I could pay $295 and get it over with, and suffer with insurance premiums. OR I could pay an extra $155 and get it reduced for sure (less points... insurance won't rape me as much), and probably even totally gone.

My last option is what I did last time, plead guilty with an explanation. The fine would get reduced a bit (probably, since I'm a student, I can beg), but no matter what I would most likely get raped by the insurance company.

Worst case senario, I pay XCOPPER, the ticket only gets reduced (that will happen at least), and I pay $450. I don't care about the money I spent because it is worth the gamble trying to get it totally gone (which I can only do with XCOPPER, not by myself), which would save me a lot more than a couple bills in insurance costs over the years.

Insurance pulls up your MVR on renewal to see your convictions and suspensions...They then add the necessary surcharges onto your premium based on your driving record ... if their minor, usually they don't do anything ... and they can raise it for the next 3 years if they wish ...

So many questions, you guys are making my head spin. hmmmm, what I sould do is post up an Insurance FAQ.

Telly, yes the officer will in testimony state what the original speed was.

SiG, yes officers make notes in their notebooks. However, traffic cops usually just write on the back of the ticket portion they keep. this is a bad sign. That guy has spent so many hours in traffic court testifying, he is usually unbeatable.

Plea guilty and pay the fine in nickles! haha
