Another one bites the dust.
Got in car accident. Soccer mom van stopped at a train track on a 50 mph street in the fast lane. Next to her is a Omni Trans van (sign posted on it, "always stops at rail road crossings". I am behind the soccer mom van, she stops. I hit her at 30-40 mph, due to brake failure. My hood is now a jagged "Z", my cleared corners are bits of plastic on the train track, my bumper is a black mass of crumbled shi*, and my radiator is cracked. Green fluids fill the street and I get out of car. A truck stops to ask if I am okay. I respond: "No, I'm dead. I'm WALKING ghost! See? There is blood in my eyes! My leg is broken, yet I walk, cuz I'm a ghost, I can do that! SO why don't you go away now and not be late to work so you can make money to feed your kids, and one day buy them a car, so that another as*hole can come along and ask them how they're doing just after they wreck their 2002 vehicle" and the guy was gone before I finished. I go to the lady, get her info, cop is here before my dad is, the omni trans bus stops. Everything is dealt with. Now the lady is telling the cop that I was behind the omni trans car and switched into her lane in order to hit her, riiight.

Well, I suppose the question is, was there a train? Or any reason for the soccer mom to stop? Otherwise, why the hell would you stop in a 50 zone? And what do you mean your brakes failed? You had no brakes what so ever in a brand new car, and this happened all of a sudden? Or do you mean you locked them up?

On the other topid the lady most likely will win the case agains you cause you hit her from behind but there is still no need to lie about you switching lanes just to hit her.
Good luck and hope you recovered soon. Just Remmember that material things are replaceable .
ouch... thats rough! sorry to hear that. i'd be so pissed/depressed right about now. expecially cause its brand new car. but dont fret my friend... hoods can be un"Z"ed, clear corners and bumpers can be replaced... just realize that the most important thing is that you, and everyone else, is not hurt.. and things will eventually look up.
sorry about the wreck dude.....but if you rear ended her then it is your fault. i dont think court is going to buy "my brakes failed on my brand new car at the wrong time". obviously you were following too close and didnt have time to stop, otherwise you wouldnt have hit her.

Unfortunately with rear end collisions, it's very difficult to prove that it's not your fault...I had one guy who backed into me, and I have a feeling that the only reason why I wasn't found at fault was because the guy didn't report the accident to his insurance company (which was my company as well) in the proper amount of time...not reporting it is an automatic admission of guilt I guess...
But fight the good fight, and be truthful...it's the best way to do things, but above all else, don't be soft. If it really wasn't your fault at all, then don't waver on your decision. But from the way it sounds, you're going to be liable in some way. They'll either get you for the situation of the accident, not keeping up your car (you're responsible for the brakes working properly), or following too closely behind. Unfortunaltely, that's the breaks. And insurance companies are very good at getting out of having to pay you large amounts of money to get your car fixed...

While im sympthetic of your situation....all i can say is, from what ive read, you made a complete @$$ of yourself!!
im sure you were mad but you still shouldnt of spoken to the helpful motorist that way, he stopped to see if you were in any imidate danger, and if he could help. All you did was make yourself look stupid!!!
What if you had been pinned in the car and couldnt move, what if your civic caught fire?? then im sure you would of been very happy to see that guy! think of that next time....

Oh man, if that were me and that lady said that....shed have so much metal in her body she wouldnt be spitting anymore lies. But I think you'll win the case since unless she used hazard lights should couldnt have legally stopped infront of you like that. Although you are on the disadvantage of being behind her. I dont know it could go either way.

I sympathize with your anger and frustration ...However, from the sounds of it, it seems you were following too closely and you are at fault. Unless your brakes really did just fail right at that moment, which I highly doubt considering its a new car, and considering that no recalls have been made regarding brake problems, it seems like you didn't react, or give yourself enough space between you and the soccer mom to react. In your description of the events, the soccer mom didn't suddenly slam on the brakes. "Due to brake failure" does that mean brake failure on your part or the car?
If the failure was from the car, I think you would say that they would investigate the automobile, but you haven't ...so it sounds like you are at fault.
And you had no right to be so scathing towards the truck driver who stopped to see if you were okay. That is immature, and wrong.
Life goes on, you're alive and okay, as are the others. Just be a conservative driver in the future and all is well.
