NEED LEGAL HELP NOW GOT HUGE TICKET

Ok here's my story, its kind of long but thanks in advance for reading it:

I was coming home with my friend P on interstate 684 yesterday. I pass him going a little over 70 mph. About 30 seconds later I was in the left lane going 70 mph when I see the minivan behind me pull to the middle lane and a state trooper in a camaro fly up and demand that I pull over. I comply and pull to the right side of the road. He then walks to my window and with very angry tone states "give me your license because it's the last time you'll see it." I reply "what?" and he restates himself angrier than before. He then asks me if I know the red 5 litre and because I do he follows me to my friends house. On the way to my friend's house I have to slow down because the light turns yellow. When I slow I hear the squealing of tires from the car behind me (the trooper) because he was following my car so closely. He then gives my friend and I a ticket for 102 miles per hour. At this point P's dad came out. We were going a little over the limit but nowhere near 102-mph. The trooper states that he clocked us both side by side going that speed. We promptly ask "show us the proof," whereby he shows us his laser gun with the 102 on it. Both P and I knew that this was total bullshit and asked for us to be shown the police recording. He replies that his in-car camera was "broken" that day. Funny how he was driving around with a broken camera and more importantly on that day only.
When asked why he didn't pull the mustang (which is at least double the power of my civic) over first, he replied that he went for the car that would give less trouble, which I found strange because the order of the line of cars in the left lane were P, a minivan, and me in front.
He was already on P before he got to me.
He also stated that I "jammed on my breaks because I have a laser detector" which is false because I have a g-tech pro in the glove box. He would not let me tell him or show him my g-tech pro, because he was convinced it was a laser detector. In fact he was quite rude the whole time, which I didn't think was that bad considering I am younger than him (me being 20), however he was extremely rude that P's father, who is a man who easily is the trooper's senior. He would not let any of us finish our sentences, and kept cutting us off. He then stated "I may look young but I have been doing this for years." An experienced trooper that really has been working at his job for years doesn't need to tell people that he has in a situation like this, we would all know by the way he has acted if he really was experienced at his job. His cutting of all of us off while we were mid sentence got so bad that P's father asked him "Can I finish a ****ing sentence?" After P's dad says this, the trooper replies "I'm leaving because I do not like the way this conversation is going."

Now my friend and I are stuck with tickets for 102 mph in a 55 zone, all because our cars are loud. We weren't racing because P knows his 5 litre can destroy my civic any day of the week. He doesn't like to race anyway. While I admit I do sometimes race, I only drag race, and on an interstate it's going to be hard to pull to a complete stop in the middle of the road without causing a 30-car pileup.

yeah and do that trick someone else did on here. when you go to court, ask him when the last time he calibrated his radar/laser gun. if he says "he" did it, you got him because it has to be done by certified people or some ish. someone help me out here, anyone remember that?

I don't know what state you are in so it makes it hard to give advice but in Cali if the CHP officer looses sight of you then they can't ticket you. So that would get your friend out. The camera being "broken" kinda helps you out. How did he clock you? did he use his gun or did he pace you? this all makes a difference. Regardless it sounds like you were speeding but there are ways to get out of all tickets.

I'd suggest pleading not guilty and getting a lawyer specializing in traffic matters. You're lucky he didn't write a misdemeanor reckless.

You have a hell of a case here. Here are the things you can use to your advantage:

1. the cops attitude after pulling you over: "give me your license...." will not look good for the cop. In america, we are innocent until proven guilty, and he cannot threaten to take your license before there has even been a court case. His choice of words were unwarranted.

2. He will need camera evidence to back up his claim that it was indeed you going 102 and not some car he clocked an hour ago. His laser should also have a time & date stamp on the locked speed record it keeps... this might help you as well, but definately use the no camera problem to your advantage.

3. The cops behavior towards the guys father. He had no right or need to take a offensive attitude towards your friend's father, and in fact can be chastized for that, as this will also be considered unwarranted harrassment of a 3rd party. His father wasn't in the car, so the cop should have been a little nicer to him.

4. bring up the fact that he was riding your *** all the way home, as this is wreckless driving... that's illegal you know... especially if he locked his brakes trying to stop behind you.

5. False accusations of a radar detector without visual proof or inspection is another thing that can be brought up. If he made no attempt to back up his claim of a laser detector, then he has no grounds for his accusation.

that is all, now go out there and nail that F'n cop to the wall... be sure to wave bye to him when leaving the court room if you win. It really burns them up.

Prove that he said it.

Wrong. We are not required to have this in New York. I am a RADAR and LIDAR instructor at the police academy.

3. The cops behavior towards the guys father. Unprofessional, but not illegal.

4. bring up the fact that he was riding your *** all the way home, as this is wreckless driving... that's illegal you know... especially if he locked his brakes trying to stop behind you.

Cops word against the defendant.

5. False accusations of a radar detector without visual proof or inspection is another thing that can be brought up. If he made no attempt to back up his claim of a laser detector, then he has no grounds for his accusation.

Wrong. We are not required to show anyone anything. You simply clock the car and write it up, that's it.

that is all, now go out there and nail that F'n cop to the wall... be sure to wave bye to him when leaving the court room if you win. It really burns them up.[hr]
It's not that easy to do.

This is a New York State trooper you are dealing with. I'm not taking anyones side here, but they are extremely well trained in this stuff and he will be at every court appearance. As I said, I think you should get a traffic attorney. The courts in New York State take the the police officer's word over the defendant, all the time. A lawyer will be able to work with the prosecutor to seek a favorable outcome for you.

First off i really doubt u were going 70 in a 55 im sure it porolly was twords 90 miles an hour. Second off theres no need for you to give everyone lip. Frankly im sick of u putting down everying with lame *** posts like "you only have a civic" and "shut up you white trash". Look at ur car its completley stock and its ugly. Also noone cares if the cop gave you crap its what all state troopers do. Its there job there not ment to be friendly. I have never met a nice one in my life. Third I would be steamed up 2 if i was a state patroll and i saw 2 dumbasskids flying down the highway. Your not mario andredy ur not brian spilner ur not an experianced driver. U shouldent be pulling that crap. I highly doubt u 2 were just strolling down the freeway going 70.. I know how i drive when im with my friends and thats certianly not it. Face that fact that you were busted and deal with it.

Why ?
Its true... p0lice are trained to do what they do and the courts always beleive what they say
As for the "whitebread" stuff... thats just ignorant
Whitericeboi is an idiot and he likes to instigate but dont fire back like that.
If you were in fact going 70 then thats a burn man... hopefully you'll get out of it
If u were messing around and maybe goin a lil too fast with your boy then you probably deserved a ticket...
peace

oh i get it! because my car looks stock it must be an eyesore. im sorry if i dont fit in with your ideals...i guess i know nothing about cars then .
taking a look at what u posted in member rides, i see that all you do is take pics of the front of the car, with the background of your daddy's big house, which he probably worked pretty hard for. From what i can see you have projector headlights which decrease visability, a drop which speedbumps love so much, oversized wheels with rubber band tires, as well as two red things up the pillars (which i have no clue as to what they are, but look bad IMO). I think beauty in a car is a powerful motor, not M3 cop off mirrors.

Actually cops are nice if you are nice to them. Of all the times ive had to deal with cops they reciprocated the respect i gave them, they never came up on an ego trip to me like that. Even when i was questioned at the department I had the detective laughing. edit: (totally different thing altogether)

And cruise control doesnt lie, 70 mph is 70 mph.

so heres a tip from me to you. learn a little about cars, i did when i was younger so i never got caught up in the typical 16 yr old male rice attitude.

p.s. your old seat in 7th grade english class seems to be calling your name back

I'm wondering why the Trooper would even care that you have a Radar or Laser detector. Because if he was behind you he wouldn't need radar. Anyone thats even a bit familier with Laser Dectotors knows that if they go off its too late, because they got you. Ka-band radar, and K- band radar, are easy to detect with a good radar detectors and most of the time will give you time to slow down becasue the radar is projected in a fan like shape. Laser is a small directed line that needs to projected on a shiny part of the car,(Licience plate, head lights, chrome bumpers) for a speed reading. Once it finds a refelction they got you and your detector goes off at the same time.

Not flamming here LikeWeeee, but I don't think we know the whole story here, the question the Trooper asked about he Radar Detector just doesn't make sence, unless of course they're illegal in you state.

102 in a 55? Don't they arrest you for that? Thats 47 over the limit. I'm pretty sure they arrest you in the states I have lived in.

Guys, keep it clean! If you're going to argue, do it in a PM or some other method...

Besides, he asked for help, not a lecture...c'mon now! I can understand not agreeing with his actions, but seriously, no need to go off on that tangent for like 5 posts...

Man some of you bash him and put him down for no reason. Some of you luv starting posts fists swinging saying junk like "you lie you weren't going 70". Grow up, stop acting like little kids.

As for your ticket, yeah, get some professional legal counsel. If he's a crooked cop, then chances are he's done this before, and chances are he knows how to get away with it. Or maybe he felt like being a jerk cus' he had a bad day. Who knows.

Your friend's father can be a good witness to the trooper's attitude, His utter rudeness can put into question his character, and therefore his integrity.
