got a stupid ash ticket....
this is what i think of CHPs...

-this is what happened....i was on my way to a import shop at Vallejo...like an hour drive away from where i live around Hayward 510 area...i was using the carpool lane with a friend of course, thinking that it was legal the whole way....but, stupid me used to our freeways around my area, it is not legal to have only 2 people in the vehicle around the vallejo area...on I-80 and all the freeways over there it has to be 3 or more....i was telling the cop that i wasn't used to the freeways over there because it's only the 2nd time i've driven up there, he said i should show up at court and explain....
-2 things make me furious about this ticket:
1. I was not familiar with the freeways in that area and I was so used to our carpool rules in my area.
2. After the cop was done with us, me and my friend saw a bunch of other people in the carpool lane with just 2 or even 1 person!!! And the worst part is that there was cops all over and even right beside them and they never pulled them over!!!....what the freak is up with that???
-please give me tips on how to address and tell my story to the judge so that he'll at least lower if not dismiss my violation....
-i was also wondering if it is a moving violation because the cop said it ain't gonna show up in my record or to the insurance people...is that true???

my buddy got the same f@ckin ticket once, but he was clearly at fault. i cant remember if he got out of his, and i cant remember if it shows up on ur record, but id definitely fight it! APPEAL that thing...

I dont know if i would go with the excuse that you werent use to the laws, that could backfire. Ignorance is no excuse. But then again, if you tell the judge you were miss informed of the law, saying you were told that two people was acceptable, you are somewhat side stepping the issue.

Yeah dood, I agree, he just hatin' on you coz you have a cool car and he's stuck with a cop car. Hahah, well I don't know how to help you coz I never got a ticket nor get pulled over in my whole life. LoL. Sorry dood... But yeah, tell them that you're innocent. 1. when you go to court don't yell and scream, makes you look stoopid and immature... be very calm and mature
2. if you haven't had a ticket in the last 18 months then you can go to traffic school... and if you're 18 or over then you can even do it online (i did it in about 30 minutes). otherwise i would imagine this is the sort of thing that would appear on your record. traffic school is generally like around 40 bucks...
- did you pass any signs stating how many people are needed for the carpool lane? perhaps you should revisit the area... if there were no signs stating that three people are needed for carpool express that when you go to court. otherwise it's sorta your fault for not reading the signs... (part of driving is being aware of your surroundings.)

This sounds like a ticket you can beat if you just say you had 2 people in the car and didn't know there had to be 3... I'm guessing it's better than 50/50 you get out of it with just a brief lecture from the guy in the robe
Of course there's some judges that will show no mercy, but I'd try it at least....

LOL Ryan... hey Vic. Just explain it to the judge that you don't drive up north east a lot from where you live. I'm pretty sure you can get dismissed IF you haven't had any previous tickets in the past. The fine SUCKS... I think it's like $200 up here and you could use that money for somethin else. If you gotta pay for your mistakes the hard way, you've got my sympathy! But I hope you can get out of this... and yeah, just keep your cool in court... sorry about the incident.

Find an attourney who specializes in traffic citations, find one that doesn't charge for consultations. I'm going to some guy in sacramento for mine in a couple of days. He doesn't charge for consultations and only charges $125 to go to court for you. My dad has used him many many times and got out of all of the tickets. It helps to talk to someone who knows how to work the system and can give you pointers or just do little things to get you out of it.

well dude sorry bout that... im talking to you on AIM right now though lol but ya just go to court and tell them where you live (well they will know) and you don't know the area. And how in every other NORMAL place the carpool lane means 2 or more people. I mean seriously most people dont know about the 3+ rule, cept the people who either pay attention to every damn sign, or live around there. Well next time you do that, buy a small dummy or blow-up doll and put some clothes on it and a wig and a hat... put it either in the passenger seat or in the back seat.. should work... unless you get pulled over and the cop sees and fines you for that too haha. worth a try hehe. good luck dude! dont wanna repeat what other people said!
that sucks man...sorry about the ticket. My question is what if you only have a 2-seater sports car? Screwed up the rear like a donkey, and cant go in that lane? That whole thing is dumb. I hope everything works out for you in the end.

There seem to be a LOT more places in Cali that offer the carpool lane for 2 people than 3! I think it's a f'ckin bitch. From Vallejo, going down south from 880 (for a very long ways), it's nothin but a 2 people carpool. I don't understand why it's different up here. I'm guessing because the majority of the people in the southbay don't carpool as much.
And Vic, there are HELLA people who break the law in the carpool lane... a lot more than you think! But on 80, I noticed myself that people are starting to get their asses swatted like flies in the carpool lane! I was goin on 80 east comin from Pinole after chillin' with my new female friend and there was moderate traffic... you couldn't really go over the speed limit and it was like a lil' after 4pm as I was headin' to my house to help Ed clear his headlights, and out of the blue I see the cop comin' up from behind me goin like 77MPH or so and I'm like, "WTF did I do?!" Then he got from behind me and drove up behind this lady drivin' a minivan who was in the carpool lane with like hella sh't in the back seats and cargo area! She must've thought that the stuff in her car would've covered her up (probably at night if the cop was blind). She got her *** pulled over by the CHP and that was it... then i ran into traffic... and saw hella fools in the carpool lane breakin the law cuz there were like 1 extra person in the car.
Hehe.. I guess I'm sort of glad there aren't any carpool lanes up in the part of 80 I frequent (from Davis to Auburn) because I think I would be too tempted to drive in it...

As a police officer in New York State, which has very similar highways to California, I *would not* have written this particular summons. I don't enjoy writing tickets and feel that everyone is entitled to make a mistake. Not being familiar with a road is a fine reason in my book. In New York, this would be an HOV (High Occupency Vehicle) violation and is a moving violation with 2 points and a fine. However, California vehicle and traffic law might term this a non-moving infraction=no points on record. You should look on the face of the ticket to find the court at which it is returnable. Contact them and inquire about the consequences of pleading guilty/being found guilty. You might also want to talk with the traffic prosecutor to see if they would be inclined to drop the ticket (if you have a clean record)....Hope this helps.

I really hope you were kidding. Plenty of police officers have lost their lives in the line of duty, and as an officer, I find your comments offensive.
