another ticket question
my girlfriends friend got a ticket for going "63mph in a posted 40mph zone" but in reality there was absolutely no 40mph sign, the only signs were 45mph. there was a 40mph sign for that area in the opposite direction, but none in the direction she was going. i would think that since the cop deliberately lied on the ticket (the ticket specifically said POSTED 40mph zone), it should be thrown out, even though she was even going too fast for a 45mph zone. i was going to tell her to make a video tape of the section where there was no 40 sign, but since then one has been added (but it was definitely after she got her ticket, and there would have to be records of when the sign was put up) her court date is sometime in march i think, so she has some time to figure something out

my friend got a ticket for parking in a "handicapped" spot that wasn't clearly marked one. i think you should figure out who maintains the signs(speed limit signs) in your case and get them to confirm where the signs are in the area that you were ticketed. FIGHT IT! good luck

sorry to say dude, but it all boils down to the fact that your girl was speeding anyways, doesnt matter if the sign isnt up or not. I thikn it would be a waste of time to fight it. Well at least in BC it would be...

I agree with Xudus, she was already speeding so what's it matter. She does deserve the ticket. Tell her to have some guts and take it. I don't think you're gonna get anywhere trying to argue it anyways... It's not worth your time. I think the most they'd do is perhaps reduce the ticket a little (say she was speeding 5mph lesser than what was written).
Contact the DOT (dept of transportation) of your state, they have records for all of that stuff, traffic patterns, signage, spacing of the signs, etc... just be prepared to sort through hundreds of pages of crap as I had to once (it was a 1400 page report for a construction zone area). Also, it is very difficult to get the ticket thrown out on the technicality you mention, judges are only people, and they know she was speeding regardless.

it might get reduced significantly if she fights it, when you go to court to fight it around here, 6mph is automatically dropped off the ticket, and they would probably have to drop the 5mph off, so it would be 57 in a 45, that would definitely be a less expensive ticket and probably less points too (i dont remember if/how many points but i would assume she probably got some)
