F'ing car salesmen. I can't stand em. I actually read through the other forum. It looks like this information is rapidly getting spread throughout cyberspace via many different Forums. I think this guy eventually might get some justice.

Yeah it's nice of them to put that at the bottom. But if ebay holds buyers responsible for fullfilling their half of the bargain then sellers should be just as liable, even if they lose money. I know I've lost money on there before.

Good point that is a known EBAY policy. I believe the buyer not the seller is the only one who isn't supposed to be able to back out of an auction.Originally posted by cdmx

But after the auction is closed they can not back out of it. This ruling is meant for when the auction is running up until 15 seconds before the auction is over. I believe that after the auction is up the contract has to be held-up and if you don't you are violating a contractual agreement if you do not hold up your end of the bargain, LAWSUIT

According to the policy even pulling out once the reserve is met or above is against the rules:
"5.2 Binding Bids. Except for items listed in a category under the Non-binding Bid Policy, if you receive at least one bid at or above your stated minimum price (or in the case of reserve auctions, at or above the reserve price), you are obligated as the seller to complete the transaction with the highest bidder upon the auction's completion, unless there is an exceptional circumstance, such as: (a) the buyer fails to meet the terms of your listing (such as payment method), or (b) you cannot authenticate the buyer's identity. "
Try to get that dealership to move or something. AZ peoples should ban together and try to get something in the paper or something like that and make the dealership broke. Just my opinion and I know it is nearly impossible to do that but I think that the dealership is full of sh*t if they pull that sh*t
this is a classic example of "too good to be true". evos around my area go for no less then 31k. 27k did sound like a tight price.. i still feel bad for that guy, i know how it feels to be excited cuz u thought u won or got something and then find out u didnt

It seems the dealer thinks they can fight it, getting as many complaints about the issue to Mitsubishi of America is probably most helpful.

However, they say its an invalid VIN so complain about 4A4MM31S24E010733 (its a white ENDEAVOR XLS 2W) just to file against the dealership.

Funny thing about this is - that dealership could have gotten out of this cheaper by conceding vs hiring all of those high priced lawyers.....oh the irony of this....

100% correct. You can cancel an auction for whatever reason, up UNTIL before it ends, but afterwards, it's a binding contract, except in real estate transactions.Originally posted by JDog2001CivicEX

Looks like the dealership backed down and is honoring the winning bid for the original car. Thanks to everyone who helped.
