Does it stay on 40 after it goes there?
If it's just a quick jump to 40 when you start your engine, nothing bad is happening, and you shouldn't be worried. You're cluster isn't broken. It is similar to when you press on the gas when you start up and your rpms jump. I don't know why it happens, but my moms mercedes does the same thing. Nothing wrong with her car.

u mod ur car? if your car is still oem stock and its stuck on 40 then ur in some deep stuff. if you had one of those indiglo gauges installed, them maybe you need to retape it. or maybe you took out the needle for some reason and put them back, then ur fawked
sorry to tell you, but your cluster has been tampered with and the needle is out of calibration. this usually happens when someone tries to install indiglo gauges and pulls out the needle. to fix it, pull out the needle and start your car. simply put it the needle back at zero.

im not sure u can fix it, maybe you should try doing that it might work. i dont think it will work. all you have to do, pull out your needle and start your car, shift and drive it for a block without the needle. then park ur car and turn it off, then you insert the needle and it'll be at zero because ur car is off, then start your car and take it for a drive. if this works, then it should be fixed if not u might need to get a new cluster, its about 5bills if you get it from ur honda dealer but its alot cheaper on ebay if theres any. and remember, never take the needle out
MAN if your under 36k ... bring that **** to the dealer.. tell them its their fault and to fix it... usually works for me... Ive gotten... two door skins, a trunk latch, a rebuilt tranny, new ebrake cable, and free matts from my dealership so far... lol.. im trying to make up for all the intrest charges that they got me for on my loan.... probally milked about 2,500 out Honda already... and still going
