OT: Cousin got into an accident...

Well she owns a 2002 LX Sport Edition... she was going to overtake a car, changed to the right lane, loss control and went to the ditch'ish / grass area... The tow truck was going to help her, my cousin called her dad and said she was stuck, in a few moments another driver tried to overtake a nother car, so he change lane to the right, did the same thing, he slammed his breaks, front wheels locked up and rotated and smashed my cousin's rear end pretty hard. Bumper, skirts, rear door as I believe.

Anyways whos at fault? The police nor the insurance agent said anything. If they don't know can both be at fault? My cousin did not use her 4ways when on the grass (is that even necessary).

I dont know the details.

But anyways I liked the 7th gen!

whoa..that really is an accident...
is she ok?

seems like the other driver since he hit you and you were already out of the way...i would like to think of it like a parked car...if you hit a parked car, you'd be at fault right?

no ones fault cause there isn't really supposed to be a car there and the opposite could've happened

Does no ones fault = both fault? Obviously someone has to take the blame because theres where the $ comes from. Yea its like hitting a parked car on the grass!

tell them i will take the sides and rear lip if it is not damage

hope she is ok from the accident....was she trying to cut ppl off or switch lane?

I don't think its totalled... I hope so, that means new car

She was trying to switch lanes to overtake the car infront of her, lost control because the right lanes are usually not fully plowed, went into the grass. Than an suv driver did the same thing she did except he slammed into her. She's ok...

dang i thought if both not at fault = both at fault 50%??

if u get into an accident (no matter who's at fault) your own insurance company pay for the damange (my dad asked the insurance broker)

I hope she's alright! She has to make sure she drives more carefully and more slowly (for the conditions) next time... and maybe even better tires (the firestones are absolute crap in any conditions!)...

Since the storm, i've been driving my mom's Sienna... gotta loooooove the Michelin Harmony tires, traction contron, and skid control
