so i got rolled tonight.
Well, a buddy and I were cruising down by Main st. in Huntington Beach when out of nowhere I get rolled. I figure its my lights, exhaust, drop, etc. Nope. I got rolled because I "wasnt wearing my seatbelt". I told the officer that I was and I have 4 point harnesses so he probably didnt see it. He said he was "staring at me through the whole intersection" and said he didnt see me wearing it. Which then turned into a heated argument. I was being cool with him until I saw him writing the ticket. I am soooo ****ing pissed. I got a ticket for no seatbelt when I was ****ing wearing it. Stupid dumbass mother****ers. Anyways, anyone know what I should do about it? Im gonna prolly go down the the huntington beach pd and talk the the commanding officer and tell him what happened. I really dont know what I can do. When the cop asked me to sign the ticket, he stated the usual, "sign here, its not a guilty plea, but its just saying that youll appear or take care of it" and I told him he will be seeing me in court if I cant get it taken care of. Anyone have any other suggestions? Im sooo mad. ****ing *******s!!!
you could try to fight it, you might have a case. You have a passenger witness there, take pictures of the intersection you guys were at. Where the cop would have been standing if he/she saw you. Then take a picture of your harness and bring it to court or the commanding officer. PM me or e-mail me for more info., might be able to help you out.

yeah...im gonna try. the worst thing they can do is say no. But my buddy said hes gonna roll down there with me. Ill keep you guys posted as to what happens. Thanks for the advice prodigy.
i live pretty close to main street in HB... lots of cops around there but i rarely see people get pulled over ... usually they are just there to make sure things dont get out of hand around the bars and resturants... and ppl racing down PCH

if it was starting to get dark, then that would hinder the cop's vision...
xam got pulled at a meet for not wearing a seatbelt, even though he had a three-point harness on... the cop was cool with him though, saying that it was better than the ones that come stock, and let him go.

np bro, i work in the legal services field and yeah, this isn't the first time i've heard this before. I've been in situations like that too, for example, i got a ticket, or my g/f got a ticket with my car when she pulled into a handicap slot. A cop backed her in and wrote us a ticket for "parking" in a handicap slot. I tried to explain to the officer that we pulled in to the slot to let traffic behind us go forward so we can take our time waiting for someone to pickup. There was a loading and unloading zone but the entrance to it was blocked by two cars. He didn't listen and still wrote us the ticket, matter of fact, when i stepped out of the car to talk to him (since we were already parked and we were getting the ticket), he commanded to step back since i was "allegedly in a situation to do a assault". I kept my cool and took it to court. I took pictures of the intersection the same time we were there, to show how busy it was, took a picture of the line of vision the officer WOULD have had if he was three cars down (since we let three cars pass us). Did some other stuff to prepare (look up the defenition of "PARKING" in CA and spoke with one of the rep. attorney's at Parker and Stanbury) In the end it worked out and i got the ticket let go.
I got a ticket in Huntington beach like 3 yrs. ago for something bogus, while driving in the beach parking drive lanes. I showed up to the court at the appropiate court date. The cop didn't show up and the ticket and everything was released. I was like...'tight.' No ticket. Hopefully everything will work out for you in the better...

damn dude... there is really nothing you can do. you can petition it, but if the cop shows up to court, the judge will pretty much favor the cop. how much is your ticket? and do you have to go to traffic school or anything like that? i'm not too sure how it goes with saltbelt tickets. if you want i can look it up on in the system for you let me know. that really sucks, sorry man
dang homie sucks to hear. just make sure that the cop isn't the commander cuz my friend went to go do the same thing you wanna do and the cop that gave you the ticket ended up being commander too see he was screwed

I just got back a check from the second ticket I successfully defeated in court. This one was for $336.xx.
Go fight it, you will most likely win. Take pictures like others said, but most of all, your presence will give you the edge.
Walk in there with confidence, knowing before hand what you will say. Dress up. Yes, in a tie and button down shirt, at the least. And don't forget the dressy shoes, if you can. Know exactly what questions you're gonna ask the officer, and be calm when the scene in court plays out differently than you anticipated.
If I were you, I would work at it by trying to prove that the officer wouldn't have been able to see the harness from his distance, whether or not you were wearing it. But don't let the question of whether or not you were wearing it even arise. Just present facts about your car, the time of day during the citation, and other circumstances that would show that the cop's judgement could have not been at its peak level during the time he cited you.
Good luck. Oh, and bring in a folder of paperwork, even if it consists only of the ticket and a copy.
